EP: MINUTES: SENTENCING TO COUNTS 1, 2, 3, AND 4 OF THE FELONY INFORMATION - The defendant is present on bond. The Memorandum of Plea Agreement is accepted. Allocution by the defendant sentencing Dalton I. Tanonaka (1) count(s) 1, 2 , 3 , 4 . ADJUDGED: Impr of 3 mos as to each count, with all terms to run concurrently. SUPERVISED RELEASE: 3 yrs as to Counts 1-3 and 1 year as to count 4, with all terms to run concurrently, upon the following conditions: 1. That the defendant shall abide by the standard conditions of supervision. 2. That the defendant not commit any crimes, federal, state, or local (mandatory condition). 3. That the defendant not possess illegal controlled substances (mandatory condition) 4. That the defendant shall cooperate in the collection of DNA as directed by the probation officer. 5. That the defendant shall refrain from any unlawful use of a controlled substance. The defendant shall submit to one drug test within 15 days of commencement of supervision and at least two drug tests thereafter but no more than 8 valid drug tests per month during the terms of supervision (mandatory condition).THIS CONDITION IS WAIVED BY THE COURT. 6. That the defendant shall not possess a firearm, ammunition, destructive device, or any other dangerous weapon. 7. That the defendant serve 3 months of home detention with electronic monitoring as arranged by the Probation Office. During this time, the defendant shall remain at his place of residence during non-working hours and shall not leave his residence without the approval of the Probation Office. The defendant shall wear an electronic monitoring device and follow electronic monitoring procedures pursuant to the Participant's Agreement and shall earn leave as determined by the Probation Office. The defendant also will be responsible for the payment of the electronic monitoring costs as directed by the Probation Office. 8. That the fine of $10,000 is due immediately and any remaining balance upon release from confinement be paid during the period of supervision on an installment basis according to the collection policy of the Probation Office but at a rate of not less than 10 percent of his monthly gross income. Interest is waived while the defendant is serving his term of imprisonment and shall commence to accrue on any remaining balance upon his release on supervision. 9. That the defendant execute all financial disclosure forms, and provide the Probation Office and the Financial Litigation Unit of the U.S. Attorney's Office access to any requested financial information to include submitting to periodic debtor's examinations as directed by the Probation Office. Special assessment: $325. EP: MINUTES: Initial Appearance; Waiver of Indictment; Arraignment and Plea of Guilty to the Felony Information - defendant present, not in custody. Defendant sworn, questioned by the Court. Consent to Rule 11 Plea In a Felony Case Before United States Magistrate signatures verified and filed. Waiver of Indictment signatures verified and filed. Memorandum of Plea Agreement signatures verified and filed. Court informs Defendant of sentencing guidelines, possible departure from sentencing guidelines, supervised release, etc. Plea of Guilty as to Counts 1, 2, 3, and 4 of the Felony Information entered by the Defendant. R&R signed, with 10 days to object. Pre-Sentence report ordered from USPO. SENTENCING as to Counts 1, 2, 3, and 4 of the Felony Information set for 11/3/05 at 2:15 p.m. before Judge Gillmor. Defendant to be released on bail as follows: Execute a bond in the amount of $25,000, secured by cash or property. The defendant is released forthwith prior to the posting of surety. A Status Hearing will be scheduled to verify that this condition has been satisfied. In the event surety is posted prior to the hearing date, the Court directs defense counsel to contact the courtroom manager to cancel the hearing. The Status Hearing to be held: 8/22/05 at 10:30am before Judge Kobayashi. (7b) Comply with pretrial services supervision, and abide by all conditions of release as directed by Pretrial Services. (7c) Maintain or actively seek employment, as directed by Pretrial Services. (7h3) Travel is restricted to: the island of Oahu and Japan. Should defendant travel to Japan, defendant shall give prior notice to Pretrial Services of his leaving the State of Hawaii and provide an itinerary to Pretrial Services.
