ORDER. Defendant's Motion to Modify Conditions of Release, Doc. # 92 , is GRANTED in part and DENIED in part. In light of his counsel's representations in court, defendant's requests to be allowed to contact witnesses on the Government's list and to eliminate the requirement of a court-appointed monitor are DENIED. Defendant's request to be allowed to use personal social media accounts is GRANTED, with the following restrictions: He may open personal Facebook, Twitter and Instagram accounts (but no accounts on other platforms), so long as they remain subject to monitoring, that he make no attempt to contact members of the witness list, and that he block any member of the Government's witness list from viewing his accounts.The Government's Motion to Detain or Alternatively to Amend Conditions of Supervision, Doc. # 107 , is DENIED in principal part and GRANTED in part. Defendant has, pursuant to 18 U.S.C. § 3143(a), shown by clear and convincing evidence that he is not a flight risk and does not pose a threat to the community or any individual person. Therefore, he shall not be detained in advance of sentencing based on the information presently known to the court and in the absence of any evidence that defendant is engaged in ongoing fraudulent activity. For reasons set forth in court, the Court does not conclude that it was improper or a violation of defendant's conditions of release for defendant to report on a Tuxedo-Junction-related social media site the result of the jury verdicts in this case. Further, the Court does not conclude that it is necessary to impose a curfew, to require the removal of all internet access to defendant's house, to prohibit defendant from engaging in any financial transaction exceeding $500, or to require defendant to provide additional sureties for purposes of bond. The Government's request that defendant be ordered to provide expedited financial disclosure is GRANTED as follows. First, within 14 days, defendant shall complete a personal financial statement of the type required by the U.S. Probation Office for a presentence report. Defendant shall update the personal financial statement 10 days prior to sentencing and as otherwise requested by the U.S. Probation Office. Second, defendant shall disclose information concerning the business activities of Tuxedo Junction as agreed to in court. Specifically, defendant shall execute any consent and releases that are necessary for the U.S. Probation Office to meet with Tuxedo Junctions accountant and to review, obtain copies of, and fully discuss its current financial condition, including all assets, liabilities, revenues, expenditures, and income, and to have access to any records that the Probation Office determines it needs to assess the business's financial condition. Within 21 days, defendant shall generate and provide to the U.S. Probation Office a financial statement encompassing all Tuxedo Junction transactions from the previous three months.
