The court recommends to the Bureau of Prisons that the defendant be designated to a facility where the Bureau of Prisons can afford appropriate medical care for his extensive medical needs/conditions. The defendant shall surrender for service of sentence at the institution designated by the Bureau of Prisons before 2:00 on 3/9/10 as notified by the US Marshal. 3 years supervised release on each of counts 1,5-9,11,13,25-27, 37 to run concurrently with each other. ( See additional sheet for special conditions of supervised release) Defendant is to pay restitution in the amount of $825,500.00 to the payess listed in the judgment. Any payment made, that is not payment in full, shall be divided proportionately among the parties named. Sable,, [22] Emergency MOTION to Revoke Detention and Set Conditions of Release filed by Steven P. Sable. This case was originally assigned to Magistrate Judge Cohen. Upon Judge Cohen's retirement this Court was drawn the case for purposes of motions. After hearing and upon consideration of the papers, this Court FINDS that while there has been a change in the medical condition of Mr. Sable, counsel's asseverations that the defendant is receiving proper medical care compels this Court not to in any way upset the ruling on detention entered by the Central District of California. In reaching its decision the Court first considers that the government's argument, which has not been disproven, that the defendant and his wife no longer reside together and/or the wife has left the defendant. For this reason, the defendant, may not be suitable to place with the wife, as requested by defense counsel. Second, the Court has received no medical evidence, directly, that the defendant's medical needs are not being satisfactorily cared for by the Plymouth County Correctional Facility. Accordingly, the Court will continue the defendant's detention as entered by the Central District of California. The Court also states that if, at any time, the defendant's medical condition cannot be satifactorily cared for by the Plymouth County Correctional Facility, then the defendant's transfer may be considered.
