MINUTE ORDER: This case having been referred to the undersigned magistrate judge for all discovery matters, the parties have requested that discovery be stayed pending a ruling by the trial court of an issue that may impact the scope of the case. The Defendant has advised the trial court that it contemplates filing a dispositive motion and has been directed by the trial court to submit a briefing schedule of the motion. After conferring with the trial court and having been advised that a briefing schedule will be approved by the trial court, the undersigned hereby grants the parties request for a stay of discovery without prejudice. Should it become apparent that a factual predicate is necessary for the trial court's ruling on the dispositive motion to be filed by the Defendant, this Court will entertain a request from either party to lift the stay for the limited purpose of affording the party or parties to engage in limited discovery to present or respond to the dispositive motion. Additionally, either party may request this Court during the stay of discovery to grant such party leave to take a de bene esse deposition of any witness for the purpose of preserving evidence. MINUTE ORDER. Based on the discussions at yesterday's discovery hearing the Court states the following: (1) Plaintiff will provide Defendant with a letter indicating what Plaintiff hopes to learn from reviewing the day planner. Defendant will then review the day planner for the time period of 3/1/06-5/15/06 to look for personal notes made by Plaintiff; (2) Plaintiff will provide responses to Interrogatories Nos. 13 and 15 and documents relating to Count V by 2/15/08; (3) Defendant will finish reviewing e-mails and provide any additional documents relating to Count V by 2/15/08; (4) Plaintiff represented she intends to take 10 depositions and Defendant represented he intends to take 4 depositions; (5) Defendant moved to preclude Plaintiff from asking questions on a certain topic at depositions and the Court sustained the objection.
