Minute Entry for proceedings held before Judge Jeanne E. Scott :MINUTE ENTRY: This cause comes before the Court on Defendant Henry D. Johnson's Motion for a Bill of Particulars (d/e 13), and Motion to Continue Pre-Trial and Trial Setting (d/e 15). The Government asserts that the details sought in Defendant's Motion for a Bill of Particulars are contained within the discovery produced by the Government to date. For reasons stated of record, the Defendant's Motion for a Bill of Particulars is DENIED. The Government has no objection to Defendant's Motion to Continue. The Court finds that the ends of justice served by granting the continuance outweigh the best interest of Defendant and the public in a speedy trial, in light of Defendant's need for additional time to investigate the case. 18 U.S.C. section 3161(h)(8)(A). THEREFORE, Defendant's final pretrial hearing, set for October 1, 2004, at 9:00 a.m., and trial, set for October 18, 2004, at 9:00 a.m., are hereby CANCELLED. TEXT ORDER: The Defendant has filed a set of Pretrial Motions (d/e 63). The Motion to Reconsider Bond is DENIED. United States Magistrate Judge Cudmore held a detention hearing on August 17, 2004, and determined that the Defendant should be detained. Order entered August 24, 2004 (d/e 8). The Motion to Reconsider contains nothing new that could not have been presented at the original hearing. The Motion for Disclosure of Brady and Giglio Material, Rule 16 Material, and Rule 26.2 Witness Statements is DENIED as premature. The Government has an ongoing obligation to produce material under Rule 16 and Brady and Giglio. Fed. R. Crim. P. 16; Giglio v. United States, 405 U.S. 150 (1972); Brady v. Maryland, 373 U.S. 83 (1963). The Defendant does not need to file a motion to secure this material. The Motion does not indicate that the Government is not complying with its obligations. The Motion is therefore premature. The request for witness statements under Rule 26.2 is also premature. This Motion should be made after a witnesses has testified. Fed. R. Crim. P. 26.2(a). The Motion to Suppress Evidence and the Motion to Reconsider Gang Affiliation are DENIED for the reasons set forth in this Court's Order entered January 18, 2005 (d/e 39).
