All capitalized terms used have the same meanings as set forth in the Stipulation of Settlement dated 2/19/02. The Court hereby awards plas' counsel attorneys' fees of 20% of the Gross Settlement Fund after the deduction of litigation expenses awarded herein. The Court hereby awards plas' counsel reimbursement of litigation expenses in the amount of $419,159.03. The Court further awards interest on the fees and costs awarded herein for the same time period and at the same rate as that earned on the Gross Settlement Fund until paid. The Court finds that an award of attorneys' fees of 20% of the Gross Settlement Fund after deduction of litigation expenses is fair and reasonable and below the Ninth Circuit's "benchmark" fee under the "percentage-of-recovery" method. The settlement was obtained solely through the extensive efforts of plas' counsel. The awarded attorneys' fees and expenses shall be paid to Lead Counsel immediately after the date this Order is executed subject to the terms, conditions and obligations of the Stipulation and in particular 10 thereof, which terms conditions and obligations are incorporated herein. STIPULATED ORDER AND FINAL JUDGMENT by Judge Frederick J. Martone: The Stipulation and the proposed Class Action Settlement is hereby approved and shall be consummated in accordance with the terms and provisions of the Stipulation. The Plan of Allocation of the Net Settlement Fund as set forth in the Notice is, in all respects fair, reasonable and adequate and is approved. The Second Amended Consolidated Class Action Complaint for Violation of the Federal Securities Laws date 5/4/02, which the Court finds pursuant to the Stipulation was filed in accordance with Fed.R.Civ.P. 11 is hereby dismissed in its entirety as to dfts, with prejudice, and without costs to any party. The Court further finds pursuant to the stipulation that during the course of the In re Finova Group Action, the parties and their respective counsel at all times complied wiht the requirements of Federal Rule of Civil Procedure 11. The Court hereby finds that pursuant to Fed.R.Civ.P. 54(b) there is no just reason for delay of entry of this final judgment and hereby directs its entry.
