The Court has received information, and based upon that information FINDS that pursuant to a posting of 9/14/06, EBAY member "dan585585" claims to have in his possession certain pieces of the hull of the RMS Titanic, which he obtained while shipping artifacts from the "twin cities" to "atlantic city new jersey." STATUS HEARING proceedings held before Judge Rebecca Beach Smith: Robert W. McFarland, Brian A. Wainger, and David J. Bederman, appeared on behalf of plaintiff; Lawrence R. The court stated that the purpose of this hearing is (1) to receive an updated report from the United States regarding the status of legislation to implement an international agreement; and (2) for the court to set a timeline for R.M.S. Titanic to pursue a salvage award. For the reasons stated from the bench, the court ordered RMST to submit a motion for a salvage award, with supporting documentation, to this court within sixty days. This motion shall include all of RMST's salvage efforts until January 1, 2007. If RMST chooses not to submit its motion for salvage award, this court will consider that RMST has absorbed the costs of salvage and does not wish to pursue a salvage award. The court further entrusts the United States, through the United States Attorney's Office, to review RMST's actions and any salvage award which it chooses to submit. The court will issue an order. ORDER that within sixty (60) days of the date of this order, RMST shall submit to this court and to the US, proposed covenants specifying conditions or limitations to be included in an in specie award, should the court determine that one is appropriate, which are consistent with the principles articulated in this order. RMST is further ORDERED to submit a a memorandum with the proposed covenants that explains how the proposed covenants would effectuate these principles. Following its submission of the proposed covenants, RMST is ORDERED to consult in depth with the US, resolve any concerns raised by the US, and revise the proposed covenants accordingly. It is ORDERED that RMST shall submit, to this court and to the US, the revised set of proposed covenants, with an accompanying explanatory memorandum, no later than sixty (60) days from the date of its submission of the original proposed covenants. Finally, it is ORDERED that the US, as amicus, shall submit its views, including any remaining concerns, on the revised proposed covenants, and provide any additional covenants or revisions that it deems are necessary, no later than thirty (30) days from the date of RMST's submission of the revised proposed covenants.
