ORDER. During a conference call with the parties today, Plaintiff's counsel requested limited additional discovery on a new cart being used by Walmart. The parties indicated that the new cart came into use after the close of discovery in this case. Rule 16 provides that deadlines established in a case management order, including discovery deadlines, may "be modified only for good cause[.]" Fed.R.Civ.P. 16(b)(4). Good cause exists when a deadline "cannot reasonably be met despite the diligence of the party seeking the extension." Fed.R.Civ.P. 16 Advisory Comm.'s Notes (1983 Am.). The Court concludes that good cause exists in this case because Plaintiff could not, through reasonable diligence, have obtained discovery regarding the new cart before the discovery deadline. The requested evidence is potentially relevant under Rule 407, although the Court makes no determination of relevancy or admissibility now. The evidence will not be used to expand expert opinions in this case; those opinions have been disclosed and the Court will hold the parties to the directions in the Case Management Order.
