MINUTE ENTRY for proceedings held before Magistrate Judge Bridget S. Bade: Telephonic Discovery Dispute Hearing held on 4/27/2018. Discussion held regarding communication and cooperation in scheduling depositions, the requirement to meet and confer on each discovery issue the parties wish to present to the court, the scheduling of the depositions of Linda Lumen and Plaintiff, Plaintiff's request to depose the Brad D69EA3B, FFN's CEO, the location for depositions, Defendant's supplemental responses to their initial disclosures and Plaintiff's discovery requests, the designation of documents as confidential under the protective order, and whether the Standing Order for Certain Employment Cases (the employment protocols) apply in these consolidated cases. The Court directed the parties to reschedule the depositions of Linda Lumen and Plaintiff and clarified that Linda Lumen's deposition will not take place on May 15, 2018 and Plaintiff's deposition will not take place on May 3, 2018. The Court directed Plaintiff to identify no more than 10 witnesses he wishes to depose in an email to Defendant's counsel, who have agreed to cooperate in scheduling the depositions of those witnesses. The Court denies Plaintiff's request to depose Brad D69EA3B or any other FFN executives who do not have personal knowledge of this matters in these cases. The Court advised Plaintiff that he may not take depositions at FFN's office. The Court explained that the MIDP applies in these cases, not the employment protocols. The Court directed Defendant to supplement their prior disclosures and discovery responses with information about Plaintiff's 2016 sales and income as soon as possible, preferably within the next week. The Court directed Plaintiff to meet and confer with Defendant's counsel about the designation of documents as confidential under the protective order. Plaintiff was disconnected from the call and so the Court directed Defendant's counsel to contact Plaintiff and arrange to set a continued discovery dispute hearing to address any remaining issues. APPEARANCES: Telephonic appearance by EFFB1C3, Pro Se Plaintiff. Telephonic appearance by Trey Lynn and Eric Dowell for Defendant Freedom Financial Network. (Recorded by COURTSMART.) MINUTE ORDER: On December 1, 2017, Defendants filed a Motion to Vacate and Reset Case Management Conference Due to Calendar Conflict. (Doc. 45.) On December 1, 2017, the Court granted the motion and reset the Case Management Conference from December 8, 2017 to December 14, 2017. (Doc. 45.) On December 4, 2017, Plaintiff filed a Response to Defendants' motion arguing that the Court should deny the motion because defense counsel delayed in filing the motion and other counsel could represent Defendants at the Case Management Conference. (Doc. 46.) Plaintiff does not assert that resetting the Case Management Conference to accommodate defense counsel's scheduling conflict will cause him any prejudice or unduly delay this matter, and the Court finds that no prejudice or undue delay will result from resetting the Case Management Conference. Therefore, after considering Plaintiff's response, the Court affirms its prior order (Doc. 45) resetting the Case Management Conference for December 14, 2017 at 10:30 AM before Magistrate Judge Bridget S. Bade, Sandra Day O'Connor U.S. Courthouse, Courtroom 304. Phoenix, Arizona. This is a TEXT ENTRY ONLY. There is no PDF document associated with this entry. (BSB, ew)
