Appellants Craig and Wendy Humphries have submitted an application for attorney's fees pursuant to 42 U.S.C. 1988. Section 1988 provides that "[i]n any action or proceeding to enforce a provision of section... 1983... of this title..., the court, in its discretion, may allow the prevailing party... a reasonable attorney's fees as part of the costs." We find that the Humphries have prevailed on their claim for declaratory relief and are thus entitled to an award of attorney's fees. See Animal Lovers Volunteer Ass'n Inc. v. Carlucci, 867 F. 2d 1224, 1225 (9th Cir. 1989)(awarding attorney's fees as to declaratory relief despite the lack of a formal order for declaratory judgment). In our January 30. 2009 Opinion, we held that the State and County procedures used in maintaining the Child Abuse Central Index ("the CACI") were constitutionally insufficient, and thus the Child Abuse and Neglect Reporter Act ("CANRA") "violates the Humphries' procedural due process rights." Humphries v. County of Los Angeles, 554 F.3d 1170, 1202 (9th Cir. 2009). This holding "materially alters the legal relationship between the parties by modifying the defendants' behavior in a way that directly benefits the plaintiff." Farrar v. Hobby, 506 U.S. 103, 111-12(1992). Accordingly, we find that the Humphries of Los Angeles ("the County") and Bill Lockyer in his official capacity as Attorney General of the State of California ("the State"). Although the Humphries are entitled to an award of attorney's fees, each defendant is not equally responsbile for paying those fees. We have recognized that if the conduct of one of the parties "was the focus of the litigation and required a larger portion of the time of plaintiff's counsel, it is appropriate to allocate the burden of the fee award accordingly."
