It is hereby ORDERED that: 1. General American is discharged from further liability under the Policies at issue in this action; 2. General American is dismissed with prejudice from this pending action; 3. Counterdefendants David Neste, Pennmont Benefit Services, Inc., and Community Trust Company are enjoined from any future assertion of claims in any state or United States court related to the Policies at issue in this action; and 4. Until otherwise directed by this Court, General American shall maintain Policies in full force and effect and not pay the cash surrender value of the Policies to any person or entity; and 5. General American's attorney's fees and costs in the amount of $48,757.47, which were incurred by General American in filing the interpleader counterclaim and the instant motion to discharge/dismiss, as well as fees incurred in opposing Plaintiff David Neste's motion for summary judgment, preparing and filing a motion to amend General American's answer to assert an interpleader cause of action, and for the preparation and attendance at the hearing of this motion, were reasonable. General American is awarded its attorney's fees and costs in the amount of $48,757.47, to be paid either out of the amount deposited with the Court, or to be deducted therefrom, prior to deposit.
