CASE STATUS REPORT
The following constitutes Plaintiff's Case Status Report as requested by this Court:
Plaintiff submitted a Motion To Amend Order to the U.S. District Court for the District of Rhode Island, asking that Court to allow Plaintiff to proceed with the deposition of Daniel Bucci. The U.S. District Court for the District Of Rhode Island held a hearing regarding the Motion To Amend Order on September 7, 2005. Judge Lisi granted Plaintiff's Motion To Amend Order, ordering Mr. Bucci to make himself available for deposition within ninety days of the date of the hearing. See Order, attached hereto as Exhibit A. Judge Lisi also granted Plaintiff's request that the deposition be a video deposition.
Plaintiff has requested dates of availability from Attorney Kristen Mix and Attorney Anthony Traini (attorney for Mr. Bucci). Plaintiff has received dates of availability from Ms. Mix, but has not received dates of availability from Mr. Traini. Mr. Traini did inform Plaintiff, however, that Mr. Bucci will not be available until November. At this time, Plaintiff anticipates deposing Mr. Bucci in November in Rhode Island.
Shortly before the September 7, 2005 hearing, Plaintiff was contacted by Judge Lisi’s clerk regarding exhibits used in the criminal case against Lincoln Park, Nigel Potter, and Dan Bucci. Plaintiff was able to view, for the first time, the documents used as exhibits and is currently preparing a supplementary disclosure certificate to adequately disclose those documents to Defendants Wembley.
