PLAINTIFF’S MOTION TO RESCHEDULE MAY 25, 2006 HEARING

COMES NOW, Patricia Emerson, through her attorneys, Zupkus & Angell, P.C., and hereby submits its Plaintiff's Motion To Reschedule May 25, 2006 Hearing. In doing so,

Patricia Emerson states as follows:

1. Plaintiff conferred with Defendants regarding the contents of this Motion.

Defendants have no objections to the request herein.

2 On May 16, 2006, this Court issued a Minute Order setting a hearing for

May 25, 2006 at 10:00 a.m.

3. Lead counsel for Patricia Emerson, Mr. Robert Zupkus, is unavailable and out of the country attending to other business on May 25, 2006.

4. Assisting counsel for Patricia Emerson, Ms. Melissa Clack, is also unavailable on May 25, 2006.

= Because of counsels’ unavailability, Ms. Emerson respectfully requests this Court reschedule the hearing for either June 5, 2006 or June 7, 2006.

6. Plaintiff has conferred with Defendants regarding the proposed dates. Defendants are also available both June 5, 2006 and June 7, 2006. WHEREFORE, and based upon the foregoing, Plaintiff respectfully requests this Court reschedule the May 25, 2006 hearing for either June 5, 2006 or June 7, 2006. Plaintiff also requests such further relief as this Court deems just and proper. Respectfully submitted on this 19" day of May, 2006.
