ORDER denying 170 Motion for Sanctions. The Defendant's motion alleges discovery abuse by the Plaintiff, but does not clearly identify the specific authority relied upon for the relief sought. "A district court has wide discretion to determine appropriate sanctions for discovery abuse under both Rule 37 of the Federal Rules of Civil Procedure and its inherent powers." Arista Records LLC v. Usenet.com, Inc., 633 F.Supp.2d 124, 138 (S.D.N.Y. 2009). "Rule 37 sanctions require a showing of violation of a court order." Id. No such showing has been made in this case. "[T]he court's inherent power demand[s], inter alia, a clear demonstration of bad faith in order to justify sanctions." United States v. International Brotherhood of Teamsters, 948 F.2d 1338, 1347 (2d Cir. 1991). Having carefully reviewed the submissions of both parties relating to the Defendant's motion, the Court does not find "a clear demonstration of bad faith in order to justify sanctions." Id.
