NOTICE. The Court's 105 order dismissed plaintiff's claim under 42 U.S.C. § 1981, the only federal claim. Thus, the 36 amended complaint's cited basis for jurisdiction, 28 U.S.C. §§ 1331 and 1343, appears to have disappeared. The Second Circuit has cautioned that where all federal claims are dismissed before trial, district courts should usually decline to exercise supplemental jurisdiction over the remaining state-law claims. See Klein & Co. Futures v. Bd. of Trade of City of New York, 464 F.3d 255, 262 (2d Cir. 2006) ("It is well settled that where... the federal claims are eliminated in the early stages of litigation, courts should generally decline to exercise pendent jurisdiction over remaining state law claims."). Nonetheless, because plaintiff has not had an opportunity to plead facts that might support the exercise of the Court's diversity jurisdiction, the Court will allow plaintiff to file a statement on the docket indicating the citizenship of each party against which plaintiff's claims are asserted and also indicating whether or not plaintiff seeks damages in excess of $75,000. The plaintiff shall file such statement on the docket within 7 days of this order. The plaintiff's statement may also address whether the Court should exercise supplemental jurisdiction if there is no diversity. ORDER. The 47 Motion for Extension of Time is DENIED. Every statement in the defendants' 44 Statement of Material Facts cites the plaintiff's May 10, 2017 deposition. The plaintiff states in the 47 motion that he "does not object to any statement in the said transcript." For Rule 56(a)(2) purposes, this amounts to an admission of each fact in the 44 Statement. His 56(a)(2) statement should reflect such, and no extension is needed for this portion of the 56(a)(2) statement. To the extent that the 47 Motion suggests that the plaintiff needs discovery to adequately respond to the 42 summary judgment portion of the Motion to Dismiss or, in the Alternative, for Summary Judgment, the plaintiff must file "an affidavit or declaration that, for specified reasons, it cannot present facts essential to justify its opposition[.]" Fed. R. Civ. P. 56(d). But any such submission that the plaintiff makes needs to be specific and definite about what discovery he is seeking and what he thinks it would show because "a party seeking to delay resolution of a summary judgment motion on grounds that he has been deprived of certain discovery materials must show that the material sought is germane to the defense, and that it is neither cumulative nor speculative[.]... [A] bare assertion that the evidence supporting a plaintiff's allegation is in the hands of the defendant is insufficient." Alphonse Hotel Corporation v. Tran, 828 F.3d 146, 151 (2d Cir. 2016) (internal quotation marks omitted). Any affidavit under Rule 56(d) must be filed within 14 days of this order. Signed by Judge Michael P. Shea on 10/26/2017.
