ORDER by Judge Aubrey E. Robinson : that the appointment of Dr. Danna Mauch, as Special Master, be extended for one calendar year, from June 1, 1995 to May 31, 1996; that the powers and duties of the Special Master, as set forth in paragraphs 1 through 14 of this Court's Order filed May 14, 1993, are continued in full force and effect; that no later than June 9, 1995, the Special Master shall submit to the Court with copies to counsel for the parties her proposed budget for the 1995-1996 appointment year; that no later than June 23, 1995, the parties shall file objectons, if any, to the Special Master's proposed budget; that defendants, by any reasonable method of their choosing, shall provide funds for deposit into the checking account previously created by the Special Master for the purpose of implementing this Court's orders, in accordance with a schedule to be determined after the Special Master's budget is approved by the Court; that the Special Masster shall serve upon counsel for the parties a copy of each request for compensation, with supporting documentation if requested by either party or the Court, when and in the same manner she submits such requests to the Court, and defendants shall have ten business days within which to file any objections; that the bank at which the checking account is maintained shall not release to the Special Master, and the Special Master shall not request from the bank, any monies out of the account unless the Special Master presents to the bank a true copy of an order of the Court permitting access to an amount certain in the account. Upon receipt of such order of the Court the bank may release, and the Special Master may withdraw, any amount up to and including the amount stated in such order; that the monies shall be held in an interestbearing account, which interest shall revert to the District upon closure of the account, which shall be no later than September 30, 1996, unless otherwise agreed to by the parties; that any amounts remaining in the account at the end of the term of the Special Master, after all fees and expense applications covering activities during the term of the Special Master are fully processed, shall be paid back to defendants; that the Special Master shall provide a copy of this Order to the bank at which the account is maintained; that defendants' obligations under Article VI of this Court's Order filed January 28, 1992 be suspended during Dr. Mauch's tenure as Special Master; that all other provisions of this Court's Order filed January 28, 1992 remain in full force and effect. Robinson : that the Settlement Agreement be and hereby is incorporated by reference into this Order; that the Letter Agreement be and hereby is incorporated by reference into this Order; that the Settlement Agreement and the Leter Agreement shall define the rights and obligations of the parties under this Order; that the District shall transfer to the Dixon Immplementation Monitoring Committee within 30 days of the file-stamped date on this Order the sum of SEVENTY FIVE THOUSAND DOLLARS ($75,000.00), to be used for the full compensation of the consultants selected by the parties in accordance with the Settlement Agreement; that if defendants miss a dealine set forth under Objective A of the Settlement Agreement, defendants shall incur monetary penalties for each deadline missed, such penalties to begin three business days after the deadline expiration, in accordance with the following schedule: $50.00 a day for the first week of delay; $100.00 a day for the second week; $150.00 a day for the third week; and $200.00 a day for each week thereafter; that any monetary penalties assessed pursuant to this Order shall be paid into a fund to be administered by the DIMC, which shall expend all such funds for the provision of direct services to DIXON class members; that the monetary penalties authorized by this Order shall terminate at the end of the 120-day period set forth in the Settlement Agreement; that should defendants fail to comply with the obligations set forth in either the Settlement Agreement or the Letter Agreement, plaintiffs shall notify the court forthwith and submit proposed dates for a hearing on plaintiffs' motion for expansion of the Powers of the Special Master.
