MINUTE ORDER: In United States v. Hubbard, 650 F.2d 293, 317-22 (D.C. Cir. 1980), the D.C. Circuit set forth six factors to consider in evaluating a motion to seal: (1) the need for public access to the documents at issue; (2) the extent of previous public access to the documents; (3) the fact that someone has objected to disclosure, and the identity of that person; (4) the strength of any property and privacy interest asserted; (5) the possibility of prejudice to those opposing disclosure; and (6) the purposes for which the documents were introduced during the judicial proceedings. Upon consideration of these factors, including that Plaintiffs do not appear to object to filing the relevant documents under seal, see ECF No. 39, is hereby ORDERED that Defendants' 35 Sealed Motion for Leave to File Document Under Seal is GRANTED. Trump et al., Civil Action No. 19-2117, ECF No. 50, it is hereby ORDERED that the parties' briefs concerning Plaintiffs' 6 Motion for Preliminary Injunction shall be treated as cross-motions for summary judgment. Per the parties' agreement, the individual plaintiffs added in the 23 Amended Complaint shall be understood to be included in Plaintiffs' cross-motion. The following schedule shall govern further proceedings as to those cross-motions: (1) each party shall file a statement of undisputed material facts by September 30, 2019; (2) each party shall file a response to the opposing party's statement of undisputed material facts by October 11, 2019; (3) Defendants shall file their consolidated supplemental brief by October 16, 2019; (4) Plaintiffs shall file their supplemental brief by October 23, 2019; and (5) the parties shall appear for a hearing on their cross-motions for summary judgment on October 28, 2019, at 2:00 p.m. in Courtroom 11. MINUTE ORDER: In light of the Joint Statement filed by the parties in Capital Area Immigrants' Rights Coalition et al. v. Trump et al. ("CAIR"), Civil Action No. 19-2117, ECF No. 40, it is hereby ORDERED that the following schedule shall govern further proceedings: (1) Defendants shall file their opposition to Plaintiffs' 6 Motion for Preliminary Injunction by August 28, 2019; (2) Plaintiffs shall file their reply by September 3, 2019; and (3) the parties shall appear for a hearing on Plaintiffs' motion on September 11, 2019, at 2:00 p.m. in Courtroom 11. As the Court noted in its order in CAIR, Defendants are permitted to file a consolidated memorandum in opposition addressing both Plaintiffs' motion in this case and the plaintiffs' motion for a preliminary injunction in CAIR, provided that Defendants file the memorandum on both dockets.
