MINUTE ORDER: The Court has received the 32 Unopposed Motion to Lift Stay to Conduct Limited Discovery Related to Settlement. On February 7, 2020, this Court stayed discovery pending resolution of Defendant's 9 Motion to Dismiss. Plaintiff now represents that the parties have reached a class-wide settlement and are preparing their preliminary approval papers, which require some limited third-party discovery to identify class members. Plaintiff therefore seeks to lift the stay of discovery. Defendant does not object to the requested relief. Accordingly, in light of these representations, the Court GRANTS Plaintiff's 32 Motion and lifts the stay for the purpose of the limited third-party discovery that Plaintiff has outlined. The parties shall file a joint discovery plan, as a joint status report, for this third-party discovery by no later than JULY 6, 2020. MINUTE ORDER: The Court has received the parties' 28 Joint Statement Regarding Scheduling Conference. The Court previously dismissed this case on the ground that it lacked subject matter jurisdiction under Federal Rule of Civil Procedure 12(b)(1). The Court of Appeals then reversed that decision and remanded this case. In the Statement, the parties rightly remind the Court that Defendant had also originally moved to dismiss the case under Rule 12(b)(6). Defendant advances that its motion to dismiss the case under Rule 12(b)(6) is ripe and pending. Defendant therefore proposes that the Court stay discovery and other matters pending resolution of its Motion. Plaintiff does not oppose that course of action. Neither party appears to propose that new briefing be submitted with respect to that Motion. Accordingly, the Court shall VACATE the upcoming February 7, 2020 Initial Scheduling Conference. Consequently, the Court also DENIES AS MOOT Plaintiff's 29 Motion to Attend Initial Scheduling Conference Telephonically or, in the Alternative, for a Continuance of the Initial Scheduling Conference. The Court shall consider Defendant's Motion under Rule 12(b)(6) and the relevant briefing (specifically ECF Nos. 9 Motion, 14 Opposition, and 15 Reply). After that Motion has been resolved, new deadlines may be set as necessary. If the parties believe that supplemental briefing is necessary in light of the Court of Appeal's decision or for any other reason, the parties shall so indicate via a Joint Status Report proposing a schedule for any such briefing by no later than FEBRUARY 21, 2020.
