ORDER. The parties shall abide by the following schedule: (1) On or before February 5, 2010, Defendant shall provide Plaintiff a copy, via e-mail, of the docket, the Complaint, and any additional pleadings, as may be appropriate, filed in the civil action In re Principal U.S. Property Account Litigation, Civil Action No. 09cv9889 (CM), now pending before the Honorable Colleen McMahon in the United States District Court for the Southern District of New York; (2) Defendant's Motion to Transfer is due on or before February 16, 2010; (3) Plaintiff's Opposition to Defendant's Motion to Transfer is due on or before May 17, 2010; and (4) Defendant's Reply in support of its Motion to Transfer is due on May 31, 2010 or 14 days after Plaintiff files his Opposition, whichever date is earlier. Plaintiff, who is representing himself pro se in this matter, is advised that the failure to timely respond to the Motion to Transfer by May 17, 2010, may result in the Court treating the Motion to Transfer as conceded and granting the request to transfer this case to the Southern District of Iowa. In addition, the Defendant shall promptly notify both the Court and Plaintiff in the event Judge McMahon orders the civil action In re Principal U.S. Property Account Litigation transferred to the Southern District of Iowa and/or grants class certification. Finally, the Clerk of the Court shall send a copy of this Order to Plaintiff via overnight delivery service at the following address: 4000 Tunlaw Road, NW, Apt. #1130, Washington, DC 20007.
