MINUTE ORDER. Defendants have filed a Notice of Administrative Action and Suggestion of Mootness in light of a new Final Rule that the Department of Education has promulgated. (See ECF No. 85.) This Court construes Defendants' Notice as a motion for leave to file a supplemental motion to dismiss on mootness grounds, and it is hereby ORDERED that, so construed, Defendants' motion is GRANTED. Accordingly, it is FURTHER ORDERED that, on or before August 9, 2019, Defendants shall file a supplemental motion to dismiss, which shall be no more than 25 pages in length, concerning the mootness questions. Plaintiffs' response to Defendants' supplemental motion shall be no more than 25 pages in length and shall be filed on or before August 30, 2019. Any reply by Defendants shall be filed on or before September 13, 2019, and shall be no more than 10 pages in length. In lieu of briefing, the parties may meet and confer about the status of the instant action in light of the new Final Rule, and if the parties determine that no further litigation of the instant matter will be necessary, Plaintiffs shall file a notice stipulating to voluntary dismissal of this case on or before July 26, 2019.
