MINUTE ORDER as to 46C022B. For the reasons stated on the record in open court, the 49 Government's Motion and Notice of Intention to Introduce Expert Witness Testimony is DENIED. It is FURTHER ORDERED that the 13 Government's Motion and Notice of Intention to Introduce Evidence of Prior Bad Acts and the 42 Government's Motion for the Court to Reconsider Allowing the Government to Open with "Other Acts" Evidence are GRANTED. Defendant's prior acts concerning the Germany-related transactions are not "intrinsic" acts. Intrinsic acts, which are not subject to Rule 404(b)'s limitations, are acts that are "part of the charged offense" or are acts that are "performed contemporaneously with the charged crime." See United States v. Bowie, 232 F.3d 923, 929 (D.C. Cir. 2000). Defendant's prior acts fit into neither of those categories. Properly classified as "extrinsic," defendant's prior acts are subject to Rule 404(b)'s limitations. Even so, Rule 404(b) poses no bar to admission of evidence of defendant's prior acts because that "evidence is probative of some issue other than character," United States v. Cassell, 292 F.3d 788, 792 (D.C. Cir. 2002)--namely, defendant's knowledge, intent, and plan. See Fed. R. Evid. 404(b)(2). Furthermore, the probative value of this evidence is not substantially outweighed by a danger of unfair prejudice. See Fed. R. Evid. 403. And it is FURTHER ORDERED that the 43 Government's Motion and Notice of Intention to Introduce Chart into Evidence and Use It in Opening Statements is GRANTED. Defendant's sole objection concerning this motion "incorporates by reference" his oppositions to the government's prior acts motions. See Def.'s Opp. to the Gov't's Mot. to Introduce Chart into Evidence and Use Chart in Opening Statement, ECF No. 45 at 1-2. But because the Court has ruled that evidence of defendant's Germany-related prior acts is admissible, defendant's sole objection to the government's chart-related motion is unavailing.
