In the response to the 153 MOTION for attorneys' fees, Plaintiff Columbia Data Products did not contest Defendant's entitlement to an award of attorneys' fees, but it did not expressly address whether it contests Defendant's entitlement to an award of litigation expenses in excess of costs taxable pursuant to 28 U.S.C. § 1920. Accordingly, it is ORDERED that, on or before August 26, 2008, Plaintiff shall file a supplement to its response to the motion for attorneys' fees addressing specifically whether it contends that that Defendant is not entitled to an award of litigation expenses, and if so providing the legal support for that argument. The amount of attorneys' fees and litigation expenses to be awarded would be determined after submission of evidence of those amounts and an opportunity for objections.
