ENDORSED ORDER re 26 Notice (Other) filed by Kendall United Methodist Church, 25 Scheduling Conference,.On November 1, 2016, the Undersigned held [ECF No. 25] a trial scheduling conference. Naturally, attorneys for both sides participated. During the telephone conference, the Undersigned, with the participation and specific agreement of both counsel, specially set this case for a trial on August 7, 2017. The Court has not yet issued the formal trial scheduling Order, but anticipated doing so today. That won't be happening, at least not today. Here's why:Defense counsel yesterday (November 3, 2016), filed a "Notice of Conflict," advising that he is set for a six-week trial in Palm Beach state circuit court from January 16, 2017 through February 24, 2017.I have a few observations.First, at the risk of stating the obvious, this does not appear to be a conflict. Our trial is specially set in August, and this purported conflict is in January.Second, the dates mentioned in the conflict don't make sense. The notice mentions a two-week trial period beginning January 9 2017, but the specific case referenced explains that the six-week trial is scheduled to begin January 16, 2017.Third, the parties, with their attorneys' involvement, jointly selected a special set trial date for August 7, 2017. The attorneys were advised to have their calendars available, so the Undersigned assumes that defense counsel had the calendar of the lead trial attorney (who filed the later "notice of conflict") and was authorized to speak on his behalf when participating in a hearing to specially set a trial in federal district court.Fourth, I assume that something about the conflict notice is a mistake. Either it was misfiled in this case and there is no conflict whatsoever (because January or February dates don't conflict with an August date) or there is a claim of a conflict but the conflict notice mistakenly refers to a case scheduled for trial in January and February, rather than the actual one slated for a state court trial in August. Either way, some error is almost certainly responsible for this obvious snafu.Fifth, assuming that defense counsel actually does have a trial in the Palm Beach case in August 2017, which would arguably generate a conflict if it encompassed the federal trial starting on August 7, 2017, then we are left with a scenario where counsel agreed to a specially set trial date here even though he has a six-week trial in state court during the same time period.So there's some potential confusion here. To avoid further confusion and to eliminate any further ambiguities about trial scheduling issues here, the Undersigned will postpone -- albeit temporarily -- the issuance of a formal, written, comprehensive trial scheduling order. This will give defense counsel the time to either withdraw the so-called "notice of conflict" or confirm that there actually is some sort of perceived conflict. Defense counsel will have until November 8, 2016 to provide the necessary clarification.If the conflict notice is withdrawn, then the Undersigned will issue the special set trial scheduling order for August 7, 2017, as planned (and as agreed to during the telephone hearing). But if it turns out that there is, or could be, a conflict, then everyone will need to participate in another trial scheduling conference to pick dates which the attorneys are confident will actually be open on the special set trial dates agreed upon. One final point:Obtaining a special set trial date is a special benefit. It monopolizes the Court's calendar to the exclusion of all other matters. It is unduly inconvenient to the Court if parties and their attorneys agree to a special set trial date and then later announce that there might be a conflict because of a trial in another case. Special set trials don't work that way. Counsel either make themselves (and their clients and witnesses) available, or they don't. It's really that simple.
