PAPERLESS ORDER DISMISSING CASE WITHOUT PREJUDICE. On December 21, 2015, this Court issued an 7 Order Requiring Joint Scheduling Report, which required the parties to file a joint scheduling report within 20 days of the appearance of a defendant. That same order cautioned the parties that "the failure to file a joint scheduling report or otherwise comply with [that] order shall result in dismissal, default, or the imposition of other appropriate sanctions, including attorney's fees and costs." On March 9, 2016, last remaining defendant Mitchell Liss appeared in the action, and to date, no joint scheduling report has been filed. Accordingly, given that the time to file such Report has long expired, and in considering pertinent portions of the record, it is ORDERED AND ADJUDGED that this action is DISMISSED WITHOUT PREJUDICE. This case is CLOSED. All pending motions are DENIED AS MOOT. The parties may move to reopen this case upon filing a joint scheduling report. Closing Case. Signed by Judge Jose E.
