The Court finds good cause to grant in part protective orders in this matter that STAYS enforcement of the subpoenas at issue. The Court need not quash the subpoenas, however, because they are not otherwise defective. Instead this Stay Order adequately protects the parties from immediate enforcement of the subpoena pending finalization of the settlement.The non-party's opposition to these motions focuses on its interest through a charging lien filed in the action and the non-party's concern that the parties' settlement may ultimately result in prejudice to the non-party. But the non-party forgets that the point of a charging lien is to prevent just that by providing notice to all parties that personal liability may follow if the lien is not lawfully honored. Non-party also forgets that a claim under a charging lien arises only upon the successful tangible recovery of funds by a litigant, not simply the existence of a settlement in principle. The record here shows that the settlement has not yet been finalized. If the settlement were to fall through, for whatever reason, any collateral litigation involving a fee petition would be unnecessary. The Court will not exercise its ancillary jurisdiction until and unless all predicates to such jurisdiction have been established. The subpoenas, therefore, are indeed premature. The parties shall file a status report, in accordance with this Order, in 30 days to apprise the Court whether the stay should be lifted. Signed by Magistrate Judge Edwin G. Torres on 12/5/2018.
