ORDER by Mag. Judge David G. Bernthal. Rule 16 conference scheduled at 10:15 on 9/18/02. Primary trial counsel for each party shall attend & be prepared to discuss all issues listed in Rule 16 & 26 FRCP. All parties shall personally appear. Corporate parties may designate a representative other than retained counsel who shall have full settlement authority. In the event of conversion to telephone, the parties must appear by telephone. Attys shall timely comply with Rule 26(1) FRCP. A certificate of compliance should be filed, but the disclosure are NOT to be filed. (CDIL-LR 26.3(A)). A meeting pursuant to FRCP Rule 26(f) shall occur at least 21 days before the scheduling conference is held. The parties shall develop a proposed discovery plan which shall be submitted to the Court not less than 14 days prior to the Scheduling Conference. Failure to timely submit a discovery plan may result in the cancellation of the discovery conference & assessment of costs. Attys are advised that requests for conversion of the hearing to telephone conference are considered only where the parties have complied with this Order(see attached Memorandum). In the event the hearing is converted to telephone conference, counsel shall provide the Court with a telephone number where the party may be reached.
