MINUTE-ENTRY: by Mag. Judge David G. Bernthal. On February 18, 2004, the Court received a letter from pro se defendant Brady Smith dated January 15, 2004. Attached to the letter is a request by defendant Smith asking the Clerk of Court to prepare copies of his letter and mail said copies to parties in the case. The letter is construed by the Court to be a motion to continue. Defendant Brady's request for the Clerk to forward copies to parties indicates defendant has not served parties with a copy of his correspondence to the Court. Defendant is directed to serve parties pursuant to the Federal Rules of Civil Procedure and file proof of service with the Court within 21 days of the date of this order, or his document will be stricken. The Clerk is directed to return a copy of defendant Brady's correpondence to him so he may prepare and serve copies on the parties. In the future, every document filed with the Court must be accompanied by a certificate of service showing that the opposing party has received a copy of the document. The certificate must identify what document is being filed and state, under penalty of perjury, when and how a copy of the document was served on the opposing party. Copies of every document filed must be sent to each of the individual defendants unless an attorney has entered an appearance on behalf of the defendants.
