TEXT ORDER entered by Magistrate Judge Eric I. Long on 12/20/18. On November 5, 2018, Defendant filed a Motion to Strike Plaintiffs' October 5, 2018, Requests for Admissions 123 . Plaintiffs' Response indicates that the majority of these requests were made with the intention of trying to authenticate documents and to negotiate stipulations of facts in advance of trial. Pursuant to the Local Rules of this District, the parties are required to be prepared to enter into appropriate stipulations and agreements at the Final Pre-Trial Conference. See L.R. 16.1(E)(3). Additionally, the parties are required to prepare a Final Pre-Trial Order that contains both stipulations of uncontested material facts as well as stipulations regarding the use of depositions and expert testimony. See L.R. 16.1(F)(2-5). Accordingly, the parties should be working together, prior to the Final Pre-Trial Conference, to enter into stipulations and agreements about the authenticity of documents and other matters that are the subject of Plaintiff's requests to admit. Therefore, Defendant's Motion to Strike Plaintiffs' October 5, 2018, Requests for Admissions 123 is GRANTED. Plaintiffs are granted leave to renew their arguments at the Final Pre-Trial Conference if, after the appropriate stipulations and agreements are reached, Plaintiffs still believe that certain facts should be admitted rather than contested. Before the Court is Third Party Defendant CHI Overhead Doors, Inc.'s Motion to Dismiss 126 . 7A17F08 or F970EF8 sued Greif Packaging LLC for injuries he sustained while he was working for CHI. Greif, in turn, brought a third party action against CHI under the Illinois law Contribution Among Joint Tortfeasors, 740 ILCS 100/1. In its Motion to Dismiss, CHI represents that it has settled its workers' compensation case with its employee, F970EF8 or 7A17F08. As part of that settlement, CHI waived its lien under the Act. Illinois law is clear that contribution from an employer is limited to the amount of the workers' compensation liability. Kotecki v. Cyclops Welding Corp., 585 N.E.2d 1023 (Ill. 1991). Having resolved the workers' compensation claim and waived its lien, there can be no additional liability against an employer for contribution. Dismissal of the third party claim for contribution is therefore appropriate under Illinois law. Lannom v. Kosco, 634 N.E.2d 1097, 1101 (Ill. 1994). CHIs Motion to Dismiss 126 is GRANTED, and the third party action against CHI is dismissed in its entirety. (The Court recognizes that this Order was entered prior to any response from Greif. CHI represented in its Motion that Greif was "not planning to file a response." However, if Greif desires to file a response, the Court will grant leave to file a timely response and reconsider this ruling, if appropriate.) (TC, ilcd)
