Smith by Mag. Judge Robert J. Kauffman. RECOMMENDED that the motions to strike (#16) be DENIED; and that the motion to strike (#25) be ALLOWED as to the consent; and DENIED as to the withdrawal of the motion to remand. FURTHER RECOMMENDED that the motion to remand (#4) be ALLOWED as to Counts 1-12, and that theses counts be REMANDED to the Circuit Court for the Tenth Judicial Circuit, Tazewell County, IL; and that parties Gale Smith, Pekin Memorial Hospital and Peoria-Tazewell Pathology be terminated from this case. FURTHER RECOMMENDED that the motion to remand (#4) be DENIED as to Counts 13-24. The parties are advised that any objection to this recommendation must be filed in writing with the clerk of this court within ten (10) days after service of this recommendation.
