Baker: Pursuant to the August 22, 2001 mandate [d/e 89] from the United States Court of Appeals, Seventh Circuit, filed on August 24, 2001, for appeal case number 00-3878, the agency having custody of the plaintiff is directed to remit the appellate docketing fee of $105.00, from his prison trust fund account if such funds are available. The claims against these defendants are dismissed, without prejudice. It is further ordered that the plaintiff's complaint against defendant Freed is dismissed, pursuant to 28 USC Section 1915A(b) and FRCP 12(b)(6) for failure to state a claim upon which relief may be granted.
