Miscellaneous Hearing |
|
MINUTE ENTRY for proceedings held before Judge Byron G. Cudmore: Miscellaneous Hearing held on 5/18/2005. Telephonic conference held with Attorney Tharp for Plaintiffs, and Attorneys Kohlman, Baker, and Posegate for various Defendants. An issue has arisen during a deposition of David Jury (phonetic). The Court hears argument from Attorneys Tharp and Kohlman and also has the court reporter read back the relevant questions and the objection posed. The Court notes that Mr. Kohlman's objection, and his instruction to Mr. Jury not to answer, is not to preserve a privilege or to enforce a limitation directed by the Court under Rule 30(d)(1). Mr. Kohlman argues that the deponent is being asked to provide an opinion in his capacity as a lawyer. Mr. Kohlman's objection is noted, but overruled and Mr. Jury is directed to answer. Under Rule 26(b)(1): "Plaintiffs may obtain discovery regarding any matter not privileged that is relevant to the claim or defense of any party." Under this broad language, the objected to questions are clearly relevant at the discovery stage. This ruling does not address the issue of admissibility at trial. (LB, ilcd)

Miscellaneous Hearing |
|
MINUTE ENTRY for proceedings held before Judge Byron G. Cudmore: Miscellaneous Hearing held on 5/17/2005. Telephonic conference with counsel John J. Tharp, Gary Kohlman, James P. Baker, and Carol Hansen Posegate pertaining to ongoing deposition noticed by Plaintiffs. Mr. Tharp raises a concern about objections made by Mr. Kohlman that he characterizes as "speaking objection and coaching". The Court listens to arguments from each side. The Court directs Attorney Kohlman, if he believes a question mischaracterizes a prior answer that the objection is to be "form of the question" and to point out the mischaracterization in a direct and generic fashion. No coaching, no speaking objection hereinafter allowed. The parties are directed to use the court reporter to verify the prior answers to see if the objection as to the form of the question is well taken. (LB, ilcd)

TEXT ORDER REASSIGNING CASE entered by Judge David G. Bernthal on 3/10/05. On 11/16/04, this matter was assigned to U.S. Magistrate Judge David G. Bernthal due to the recusal of U.S. Magistrate Judge Byron G. Cudmore. The latter recusal was required because a counsel of record, James P. Baker, served as a member of the committee appointed to advise the Court regarding the reappointment of Judge Cudmore. The Committee has completed its task and been discharged. Accordingly, the grounds for recusal have been removed. This case is reassigned to Judge Byron G. Cudmore for all further proceedings. Judge David G. Bernthal no longer assigned to this case.(VB, ilcd)

TEXT ORDER: The Court has received Plaintiffs' Motion for Extension of Time to File Response to International Union Defendants' Motion for Discovery Sanctions (d/e 245). Plaintiffs' counsel requests a three week extension, from March 4, 2005 until March 25, 2005, due to conflicts with other assignments and a need to familiarize himself with the file. Defendants object to a three week extension, but do not object to a one week extension. The Court notes that one of the conflicts Plaintiffs' counsel mentions in his Motion will resolve itself by February 23, 2005. THEREFORE, Plaintiffs' Motion for Extension of Time (d/e 245) is ALLOWED, in part. Plaintiffs are directed to file their response to Defendants' Motion on or before March 18, 2005. Entered by Judge Jeanne E. Scott on 2/23/05. (CC, ilcd)

MINUTE-ENTRY: by Mag. Judge Byron G. Cudmore. Before the Court is the Joint Status Report Regarding Discovery (d/e 166) filed by the parties as directed by this Court on 12/9/03. The Court appreciates the detail, some of the concessions made by the parties, and overall tone of civility expressed by the attorneys in the joint status report. As recommended by the parties, a supplemental status report is to be filed on or before 2/9/04, which is one week after the parties will again meet on 2/2/04 to discuss certain remaining discovery issues. The Court asks that the supplemental status report of 2/9/04 track the format in the joint status report filed 1/20/04. The supplemental status report should also contain a supplemental scheduling proposal that would govern the remainder of the litigation. Suggested dates agreed to by all parties should be noted and where there are differences, the respective positions of the parties with suggested deadlines should also be noted. The Court therefore reserves ruling on all pending motions to compel. Upon receipt of the 2/9/04 supplemental status report, the Court will rule on certain aspects now pending or set the matter for telephonic hearing or scheduling hearing. (cc: all counsel) (CC, ilcd)

MINUTE-ENTRY: by Mag. Judge Byron G. Cudmore. On 11/14/2003, the petition of Defendants for permission to appeal was denied by the Seventh Circuit (d/e 165). Pending herein are various motions: Motion to Compel filed by Plaintiff (d/e 117), Motion for Discovery Sanctions filed by Defendant United Steel Workers (d/e 125), and Motion by Plaintiff for Modification of Expert Disclosure Schedule (d/e 153). The Court has previously received from counsel correspondence outlining various approaches to solve the discovery disputes at issue (see previous minute entry of 8/13/2003). The parties are directed to meet and confer to discuss the pending discovery disputes and other discovery disputes mentioned in the correspondence that has been formally brought to the Court's attention. After the parties meet and confer, they are directed to file a status report outlining the discovery disputes and issues that remain, the respective positions taken by each party, along with suggested scheduling deadlines to be entered in this case to control the forward progress of the litigation. Status report to be filed on or before 1/12/2004. The Court takes all discovery issues under advisement pending receipt of the status report. New deadlines to control the forward progress of the litigation will be put into place after a review of the status report. (cc: all counsel) (AJ, ilcd)

MINUTE-ENTRY: by Mag. Judge Byron G. Cudmore: On 5/28/2003, the Court indicated it would defer all discovery dispute decisions pending Judge Scott's order concerning a Motion to Dismiss (see d/e 127). On 7/31/2003, Judge Scott entered an Order denying International Union Defendants' renewed Motion to Dismiss (see d/e 127). On 5/23/2003, 5/30/2003, 6/2/2003, and 6/3/2003, counsel herein wrote correspondence to the Court suggesting various approaches to solve the discovery disputes at issue in this case, and discovery disputes that may come to issue in the future. The Court has re-reviewed that correspondence. The parties are directed to meet and confer in an attempt to resolve the pending discovery disputes now filed before the Court (d/e 117 and d/e 125). The parties are also directed to meet and confer and discuss other discovery disputes mentioned in the various correspondence that have not been formally brought to the Court's attention. The parties are directed to file with the Court a status report listing the discovery issues that remain after they meet and confer. That status report should outline, in summary form, the discovery issues and the respective positions taken by the parties. Status report to be filed with the Court on or before misc ddl 9/15/03 Upon receipt of the status report and the Court's review, a discovery conference will be scheduled, if necessary, in open court in Springfield. Also before the Court is Plaintiffs' Request for Modification of Expert Disclosure Schedule (d/e 153). The parties are directed to discuss any requested modifications of the deadlines now entered in the above litigation, and to file same contemporaneous with the status report on the discovery issues.
