MINUTE-ENTRY: by Mag. Judge David G. Bernthal. The Court has allowed Plaintiff's Motion for Leave to File Amendment to Complaint (#22). The amendment to complaint attached to the motion may stand. The Answer to Third Claim for Relief (#23) may likewise stand. The Court did consider the objection based on futility. Although the Court is not ruling that Plaintiff's claim is sustainable, it did not reach the conclusion that the filing was futile. The Court has concluded that there is no justification for extending the discovery cutoff. Defendants claim that Plaintiff has just introduced the sale of stock as an issue in the case. However, that issue was clearly known to the Court in July of 1999. In an Order (#19) entered July 12, 1999, the Court noted, "Plaintiff states that he and Individual Defendants agreed that he would get stocks...." Thus, it is clear this is not a new issue.
