The Court finds that Plaintiff specifically abandoned his claims for lost wages in the Second Amended Complaint 35 and his statement in his motion for protective order 50 where he stated that he was not seeking lost wages in this case. The Court additionally finds that Defendants detrimentally relied on Plaintiff's representation that he was no longer seeking lost wages as an element of damages. Thus, the Court precludes Plaintiff from presenting expert discovery on the lost wages aspect of his claim. The Court declines to award Defendants costs and attorney's fees in bringing the motion. The Court grants Defendants' motion for extension of expert discovery disclosures 119 . Defendants' expert disclosures are due by 9/21/2020. Expert discovery closes on 10/21/2020.
