ORDER In light of the public health situation, the Court encourages all parties and their counsel to take precautions, be reasonable, and use common sense in pending cases. In General Order No. 20-0012 dated March 16, 2020 (and amended on March 17), the U.S. District Court for the Northern District of Illinois extended all deadlines in civil cases by three weeks. Parties should assume that this Court will accommodate reasonable requests for extensions in the coming weeks, and counsel should show flexibility and accommodate each other too. This Court will grant a six-week extension of fact discovery if requested (and there is no need for an immediate request). Parties should not take depositions before April 17 unless (1) they take place telephonically; and (2) all parties and the witness(es) consent. Even a telephonic deposition often requires an in-person meeting to prepare the witness, so telephonic depositions can go forward only if everyone agrees. If any party or witness wants a deposition to take place in person, the deposition will take place after April 17. Needless to say, that date may change as the public health situation continues to evolve. Parties should continue to make progress in their cases when possible, but in a manner that is consistent with public health and safety. In the meantime, continue to work together cooperatively in the best traditions of our shared profession. Counsel discussed the Initial Status Report for Reassigned Case, the subject matter of the litigation, and the status of discovery. Aside from the discovery at issue in the motions pending before the Magistrate Judge (Dckt. Nos. 100 , 113 , 118 , 129 , 132 ), counsel represented that the only outstanding discovery requests were two pending third-party subpoenas. Plaintiff's counsel represented that she had issued a subpoena to a non-party law firm. Defendants' counsel represented that they issued a subpoena for a third-party witness who has not yet been produced (the third-party is also represented by Plaintiff's counsel). The Court directs Plaintiff and Defendants to move to enforce these subpoenas by November 12, 2019. If the parties find they need to issue additional discovery requests, they must file a motion for leave to take additional discovery. Counsel discussed the motions for sanctions (Dckt. Harjani: The Court notes that the parties have a large number of discovery dispute, which have been recently referred by Judge Seeger to this Court, but that substantial time has passed since these matters were fully briefed before the prior assigned district judge. Defendant's Motion to Compel 109 is an example of a number of simple discovery disputes, with obvious solutions, that should have been resolved between the parties without judicial intervention. The Court orders both parties to engage in a new meet and confer discovery conference on or before October 25, 2019, and to cooperate and work in good faith to determine whether any of these disputes have already been resolved since the motions were filed, and whether any disputes can be resolved now that would moot parts of the pending motions. The parties are ordered to file a joint status report that identifies any resolution of the pending motions by 10/28/19. To the extent that either party has requested sanctions, the Court will consider the reasonableness of each party in raising discovery objections to determine whether the non-production was substantially justified under Fed. MINUTE entry before the Honorable Sunil R. Harjani: Defendants' Motion to Compel 109 is granted in part and denied in part. First, although Plaintiff previously launched an objection, Plaintiff has now agreed to produce his tax returns, but defendants note there continues to be several outstanding tax return documents that were missing from the production. Plaintiff is ordered to produce the remaining tax return information. Second, Defendants move to compel production of relevant communications between him and Nikki Zollar. Defendants have narrowed the scope of the request to all communications relating to the allegations in the Second Amended Complaint, while Plaintiff wants to narrow it to documents that supports a claim or a defense. Neither party addresses whether there is even a material difference between these two formulations. However, Defendant's proposal is better phrased, reasonable, seeks relevant information, and is proportional to the needs of the case. The Court orders production of these documents under that proposal. The parties also dispute the timeframe of the production and remarkably the meaning of the word "present." The Court interprets Defendants' request as seeking documents up to when the request was served, and orders production of documents up to that timeframe. To satisfy relevancy and proportionality concerns, discovery requests should have temporal scope that relate to the time-period of the underlying events that are alleged in the Complaint; they do not continue to exist for eternity. The Court cannot imagine why this is even an issue, because the underlying facts occurred in 2016 and 2017, and neither party addresses whether these two individuals have even communicated in 2018 or 2019 about the subject matter of the Complaint. To the extent any party wishes to introduce a new communication that somehow relates to the allegations of the Complaint at trial, Fed. R. Civ. P. 26(a)(3) requires production of all trial exhibits and it can be handled in that manner. Plaintiffs are also ordered to respond to Defendants' Interrogatories Nos 6-8. Plaintiffs' current response, which consist of "see deposition of [witness name]" is improper and unacceptable under Fed. R. Civ. P. 33(b)(3), which requires an interrogatory " be answered separately and fully in writing under oath." The Court orders that these discovery tasks shall be completed by October 31, 2019.
