In response to my inquiries, the City of Chicago said that while it would not agree to the entry of a temporary restraining order pending decision on the Motion, it represented that no further promotions to the grade of Lieutenant would be made until the motion was resolved by Judge Dow, either as an initial matter, or upon his de novo review of any Report and Recommendation that I might make. That promise is binding as a representation made to a judge. Cf. Charter House Insurance Brokers, Ltd. v. New Hampshire Insurance Co., 667 F.2d 600, 604 (7th Cir.1981)("an attorney's promise in open court to produce certain documents 'could be treated as the equivalent of an order' for Rule 37(b) purposes."); Murata Mfg. Co., Ltd. v. Bel Fuse, Inc., 422 F.Supp.2d 934, 940 n. 6 (N.D.Ill.2006)(collecting cases). Counsel for the City is to be commended for their responsible and professional handling of the situation. Because of the exigent nature of the motion, counsel for the City has said that they would like to and can expedite the filing of their response brief. Accordingly, the City brief shall be due on 4/8/10. The City's oral Motion For Leave To File A Twenty Page Brief is granted. The plaintiff's reply brief shall be due on 4/15/10 and the case is set for further status on 4/19/10 at 9:00 a.m. The parties are reminded of Local Rule 5.2(d), which requires that exhibits attached with briefs be separated by protruding tabs and Local Rule 5.2(f) which requires prompt delivery of courtesy copies of briefs to chambers. Finally, the City should feel free in its brief to make whatever argument it deems appropriate to support its claim that the plaintiff cannot prove a likelihood of success on the merits, and nothing I may have said should be construed to the contrary. My point was that an argument that was based on the insufficiency of the complaint -- and thus was functionally a motion under Rule 12(b)(6) -- could and should have been made to Judge Dow over the last two years and that I do not have jurisdiction to decide whether the complaint states a claim upon which relief can be granted. Unlike non-dispositive matters that can be referred to be heard and determined by a Magistrate Judge, 28 U.S.C. §636(b)(1)(A) prohibits a District Judge from referring to a Magistrate Judge for plenary determination a motion that disposes of a claim or defense including motions for injunctive relief, for judgment on the pleadings, for summary judgment, to dismiss or permit maintenance of a class action, to involuntarily dismiss an action, or to dismiss for failure to state a claim upon which relief can be granted. The list of prohibited motions is generally interpreted as illustrative, not exhaustive. See Williams v. Bee Miller, Inc., 527 F.3d. 259 (2nd Cir. 2008). The statutory prohibition does not mean, however, that a Magistrate Judge can play no role in the decision of dispositive motions, including those specified in 636(b)(1)(A). The Federal Magistrates Act of 1968 specifically authorizes a District Judge to assign such matters to a Magistrate Judge for issuance of a report and recommended disposition, including any proposed findings of fact. 28 U.S.C. §636(b)(1)(B); Rule 72(b). However, Judge Dow has not sent the motion for a temporary restraining order here for a report and recommendation. Therefore, the motion is denied without prejudice.
