ORDER: On October 12, 2018, Plaintiff, who was incarcerated when he filed this lawsuit, notified the Court that he was no longer in custody. 31 On December 18, 2018, Plaintiff missed a court date, and the Court set a status date. 41 On December 26, 2018, the court denied Plaintiff's motion seeking attorney representation, referred him to the Pro Se Help Desk, set a status date, and warned him that he must appear in person or through counsel he retains at any court status or motion dates. 42 Plaintiff did not appear at status hearings on January 15, 2019, or February 1, 2019 44 45 , and the Court, on February 1, 2019, dismissed the case for Plaintiff's want of prosecution and entered, and amended, judgment that day. 45 46 47 Court records reflect that orders generated between October 12, 2018, through the amended judgment were sent to Plaintiff at the address he provided. 31 32 42 44 45 48 . Plaintiff by letter now states that he "ha[s]n't received any paperwork" regarding his case in an unspecified amount of time, except that he "put an [sic] motion for representation that was denied." 48 The Court's orders, sent to him at the address he provided, are presumed to have been received, United States v. Miller, 661 F.App'x 445, 448 (7th Cir. 2016) (collecting cases), and the orders warned him of his obligations and the consequences of inaction. ORDER: Since Plaintiff's criminal proceedings terminated due to his transfer to state custody on July 6, 2018, the Court ordered Plaintiff to submit a second amended complaint that included the disposition of his criminal case and all facts, claims, parties, and exhibits Plaintiff wished the Court to consider. 19 Plaintiff submitted a second amended complaint and a notice of change of address, in which he explains that he is in state custody because he "took some time on [his] other case" but is "still fighting" the criminal charges related to the facts of this case. 21 Plaintiff has also provided another letter with an update of the criminal proceedings. 23 Because Plaintiff's underlying criminal proceedings are ongoing, the Court's request for a second amended complaint including the disposition of those proceedings was premature.
