MEMORANDUM Opinion and Order. Signed by the Honorable Manish S. Shah on 4/2/2018: Defendants' motions to dismiss 22 , 38 , 40 , and 43 are granted. Plaintiff's complaint is dismissed without prejudice in part (for lack of jurisdiction and with respect to relinquished state-law claims) and with prejudice in part (for failure to state a claim). Enter judgment and terminate civil case. [For further detail see attached order.] Notices mailed. (psm, )

MINUTE entry before the Honorable Manish S. Shah: Plaintiff's motions to set a date for trial by jury 71 72 are denied. It is premature to set a trial date because of the pending motions to dismiss, and plaintiff's request for a jury trial is noted. No further action by plaintiff is necessary to preserve his request for a jury trial. Plaintiff's emergency motion 73 is denied, for the same reasons the court denied plaintiff's earlier emergency motion. See order of 11/20/17, Dkt. No. 52. Plaintiff again asks this court to take action against individuals suspected of committing crimes and to stop ongoing state-court proceedings. The state-court system is capable of addressing disputes within the cases pending there. See also 28 U.S.C. § 2283. Plaintiff should wait until this court has ruled on the defendants' motions to dismiss before attempting to litigate his claims, because the motions raise arguments about this court's power to hear this dispute. This case should proceed one step at a time. Defendant Nyuli's motion to set a status hearing 75 is denied. Plaintiff's recent motions have been ruled upon and no response from defendants is necessary. All matters are stayed pending a ruling on the motions to dismiss, in which any further dates will be set as needed. Notices mailed. (psm, )

MINUTE entry before the Honorable Manish S. Shah: Plaintiff's emergency motion and request for an emergency hearing are denied. In the motion, plaintiff asks the court to nullify certain state-court orders and to enjoin ongoing state-court proceedings. He also asks the court to charge certain people with crimes, sanction an attorney for conduct the attorney committed in the state-court case, and clarify plaintiff's property interests. These are not appropriate requests for a federal court to address on an emergency basis. First, the federal courts do not initiate criminal charges of identity theft or property theft. Those kinds of criminal charges are initiated by the executive branch. The judiciary generally is not authorized to second-guess a prosecutor's decision to charge a crime (or not charge a crime). Second, a federal court does not independently enforce the ethical rules of conduct that apply to lawyers and judges practicing in state court. Those rules are enforced by an administrative disciplinary process, for example, by the Illinois Attorney Registration & Disciplinary Commission and the Illinois Judicial Inquiry Board. Claims of attorney or judicial misconduct are ordinarily presented to those agencies. Finally, a federal district court should not interfere with ongoing state-court proceedings, review the propriety of state-court orders, or declare state-law property rights that are the subject of ongoing disputes in state court. Review and challenges to state-court orders should take place within the state court system (subject to ultimate review by the United States Supreme Court). The matters raised in the motions are not emergencies warranting federal court intervention. Notices mailed. (psm, )
