The defendant participated at the hearing today over objection because of its concern that the plaintiff might argue that it constituted a waiver of its pending motion to disqualify plaintiff. I denied that objection and ordered that the hearing proceed. Obviously, the defendants' participation shall not constitute a waiver of the motion to disqualify. With commendable candor, plaintiff's counsel acknowledged that they will make no contention that that participation has any effect on the pending motion to disqualify. The Plaintiff's motion on page 5 alludes to the defendants' claimed failure to "produce electronic discovery" and to schedule depositions. Beyond this generalized assertion, which it is alleged is pursuant to a "self-imposed stay on discovery" designed "to delay this case in hopes that the potential class will dissipate," (Motion at 5-6), there is no amplification of the argument and none of the 11 exhibits supports the claim. Consequently, the argument will not be considered under the familiar principle that skeletal and unsupported arguments are waived. Puffer v. Allstate Ins. Co., 675 F.3d 709, 718 (7th Cir. 2012); Kyles v. J.K. Guardian Sec. Services, 236 F.R.D. 400, 401 (N.D.Ill. 2006)(collecting cases). Any further requests for a judicial ruling on these issues must be preceded by a comprehensive L.R. 37.2 conference. Even more significant is the fact that the submission, which in total consists of 130 pages, was submitted unbound in any way, with all the pages simply loosely put in an envelope. The plaintiff is instructed to immediately deliver to chambers a bound courtesy copy of the motion with protruding tabs and that in all other aspects complies fully with Local Rule 5.2. The parties should be aware that if they cannot agree on dates for depositions, the court will set those dates. The parties are further reminded that: discovery, like all matters of procedure, has ultimate and necessary boundaries. Hickman v. Taylor, 329 U.S. 495, 507 (1947). The discovery rules are not an excursion ticket to an unlimited, never-ending exploration of every conceivable matter that captures an attorney's interest. Parties are entitled to a reasonable opportunity to investigate the facts-and no more. Vakharia v. Swedish Covenant Hosp., 1994 WL 75055 at *2 (N.D.Ill.1994)(Moran,J.). See Robinson v. Stanley, 2010 WL 1005736, 5 (N.D.Ill.,2010). The parties are further reminded that boilerplate objections do not count and will result in a waiver. United Auto. Ins. v. Veluchamy, 2010 WL 749980, 5 (N.D.Ill. 2010)(collecting cases). Finally, while the concept of relevancy under Rule 26 is broad, it is not limitless and that the Supreme Court has cautioned judges that the requirement of Rule 26(b)(1) that the materials sought in discovery be relevant should be firmly applied. Herbert v. Lando, 441 U.S. 153 (1979). Failure to exercise that control results in enormous costs to the litigants and to the due administration of justice. Cf. Bell Atlantic Corp. v. Twombly, 550 U.S. 544 (2007); Frank Easterbrook, Discovery as Abuse, 69 B.U.L.Rev. 635 (1989). Participation by telephone will not be permitted as explained in my Instructions and Procedures for Settlement Conferences. Failure to comply with this requirement may result in a substantial monetary sanction and may necessitate the cancellation and resetting of the conference with the attendant additional costs associated with the rescheduled conference not only those of the non-compliant party, but also those incurred by the compliant party. As provided in the instructions, plaintiff's counsel shall deliver copies of the required settlement letters to chambers from both plaintiff and defendant by no later than (4) calendar days before the conference. All settlement documents must have protruding tabs separating exhibits or attachments, pursuant to Local Rule 5.2(e). Non-compliance with the 4-day Rule makes it difficult and often impossible for the conference to proceed effectively. Failure to comply with the 4-day Rule may necessitate cancellation of the conference. Parties cannot unilaterally agree to cancel a scheduled settlement conference. Permission not to proceed must be obtained from the court pursuant to written motion, and any party wishing to vary any of the procedures set forth in the standing order must make an appropriate request by written motion prior to the exchange of settlement letters described above.
