The United States of America's Motion for Leave to Appear as Participant in Settlement Conference 491 is granted over the objection of the intervenors. The objection that Judge Holderman's referral, being for the purpose of holding settlement discussions "among the plaintiffs, defendants, and intervenors" by its terms, precludes the Government from "participa[ting]"in the conference reads too much into the text of the minute order of 4/26/2010. "Judges expect their pronunciamentos to be read in context,"Wisehart v. Davis, 408 F.3d 321, 326 (7th Cir. 2005)(Posner, J.); see also Penry v. Lynaugh, 492 U.S. 302, 358 (1989)(Scalia, J., concurring and dissenting in part); McCready v. Jesse White, 417 F.3d 700, 702-703 (7th Cir. 2005)(Easterbrook, J.); United States v. Corey, 232 F.3d 1132, 1166 (9th Cir. 2000), and the issue presented by the motion to participate was not remotely before the Chief Judge when he referred the case here. The intervenors' concern that the Government may well frustrate rather than further settlement has more weight. But the Government has not asked to intervene as a party, but merely to participate, and the scope of that participation is easily canalized within bounds that can be set by the court. As discussed in court today, the government's role is advisory only, and if it becomes clear that the Government's participation becomes obstructive rather than ameliorative the permission granted by this Order can be withdrawn. As things now stand, however, participation by the Government may bring a perspective to the issues that has not occurred to the parties and the intervenors, but which they may find unobjectionable and perhaps even informative. In that event, there would be no need for the Government to file a formal objection at the time when a settlement agreement is presented for approval to Judge Holderman.
