MINUTE entry before the Honorable Jeffrey Cole:Settlement conference held. The case is settled, and the materials terms of the settlement were placed on the record. The parties agreed that contract formation occurred today, and that there was a binding settlement agreement today even though it contemplated a future written document. Phrased differently, the execution of the contemplated agreement is not a condition precedent to contract formation. See Alliance for Water Efficiency v. Fryer, 808 F.3d 1153 (7th Cir. 2015); PFT Roberson, Inc. v. Volvo Trucks North America, Inc., 420 F.3d 728, 731 (7th Cir.2005); Loop Paper Recycling, Inc. v. JC Horizon Ltd., 2010 WL 1655254 (N.D.Ill. 2010). The court wishes to express its appreciation to Dina Ninfo of Angelini & Ori, LLC, counsel for the plaintiff and Timothy Wolfe of Ogletree, Deakins, counsel for defendant. That a settlement was reached is attributable to the sensitivity and flexibility of counsel. Their conduct proves that lawyers can act civilly and courteously in their dealings with opposing counsel without sacrificing in the slightest the obligations they owe to their clients. All matters relating to the referral of this case having been accomplished, the referral is closed and the case returned to Judge Wood. Nor is it satisfied by someone who must make a phone call to get permission to settle the case beyond an amount set forth in their preconference submissions to the court. ALSO MANDATORY, IF POSSIBLE, IS THE INCLUSION BY BOTH SIDES IN THEIR SETTLEMENT DOCUMENTS OF COMPARABLE RESULTS.
