ORDER: Because Plaintiff remains in custody (although at a different jail), the Court vacates its October 10, 2017, order 5 directing Plaintiff to provide an updated in forma pauperis application. Plaintiff's application for leave to proceed in forma pauperis 3 is granted. The Court orders the trust fund officer at Plaintiff's place of incarceration to deduct $2.80 from Plaintiff's account for payment to the Clerk of Court as an initial partial payment of the filing fee, and to continue making monthly deductions in accordance with this order. The Clerk of Court is directed to send a copy of this order to the Supervisor of the Inmate Trust Fund Accounts at the Scott County Jail. The Court further directs the Clerk of Court to: (1) file Plaintiff's complaint 1 ; (2) terminate the Riverdale Police Department as a Defendant and correct the docket to reflect that the Village of Riverdale, rather than "Riverdale Township," is a Defendant in this matter; (3) issue summonses for service on Defendants Village of Riverdale and Officer Jordan by the U.S. Marshal; and (4) send Plaintiff two blank USM-285 service forms, a magistrate judge consent form, filing instructions, a copy of "Filing a Civil Case Without an Attorney: A Guide for the Pro Se Litigant," and a copy of this order. The Court advises Plaintiff that a completed USM-285 form is required for service on each Defendant. The U.S. Marshal will not attempt service on Defendants unless and until the required forms are received. The U.S. Marshal is appointed to serve Defendants. ORDER: Plaintiff 95C8938 initiated this lawsuit while he was detained in the Cook County Jail. He has subsequently been released. Before the Court addresses Plaintiff's in forma pauperis application, which shows his inability to pre-pay the $350 filing fee (but an ability to pay an initial partial filing fee of $2.80), he must submit an updated in forma pauperis application showing his current financial and employment status so the Court can assess his ability to pay the filing fee in light of his release. See Robbins v. Switzer, 104 F.3d 895, 897-98 (7th Cir. 1997) (the Prison Litigation Reform Act applies if a plaintiff filed suit while incarcerated, and the plaintiff remains responsible for payment of the full filing fee). Failure to comply with this order by November 9, 2017, will result in dismissal of this case for want of prosecution.
