MINUTE entry before Judge Blanche M. Manning : The court previously held that the current plaintiff lacks capacity to file this action and gave her a chance to substitute the correct plaintiff. It appears that State Probate proceedings are pending. Those proceedings will determine who the proper plaintiff is. Hence, counsel's motion for leave to withdraw 39 is granted, and this case is dismissed without prejudice as the present plaintiff does not have the capacity to file a federal action at the present time. Towanda Ware, Mary J. Edwards, and Shemeka R. Blandin's motion for leave to intervene 35 is denied without prejudice as the proposed interveners do not address the requirements of Fed.R.Civ.P. 24 and, in any event, the court has declined to allow the present plaintiff to proceed with this action. Specifically, the court finds that Ruther Mae Wilson is not a real party in interest. However, the court declines to dismiss her complaint outright at this point as pursuant to Rule 17(a), the court must give her a reasonable time to substitute the actual real party in interest. Thus, as outlined below, the parties shall file short memoranda by 10/30/06, regarding the real party in interest issue. If no one will have the capacity to file a federal action on Mr. Wilson's behalf by this date, the parties should so advise the court and the court will then dismiss this case.
