ORDER: During the final PTC, the US advised the Court that it had identified additional case law suggesting that the Court lacks jurisdiction over this case. R. 145 . The Court asked the parties to address this new case law via briefs due November 17. After a quick review of the briefs and the cases they cite, the Court recognizes that a thorny issue exists forresolution. Given this, and knowing that the parties might otherwise spend their Thanksgiving holiday preparing for the trial, the Court recommends that the parties suspend their trial preparation at this time. The Court will endeavor to resolve this issue as soon as possible after it receives the parties responses due November 21. See R. 145 . The Court will also keep the December 5 trial date for now, and if the Court denies the US renewed motion, the Court will be prepared to proceed to trial as planned.
