Magistrate Judge Donald L. Cabell: ELECTRONIC ORDER entered denying 19 Motion for Protective Order. The plaintiff's motion for a protective order is DENIED. The plaintiff seeks two forms of relief but none is appropriate here. First, regarding the plaintiff's request that she be freed from appearing for her deposition noticed for July 26, 2018, that date has passed and the request is therefore moot. Second, regarding the plaintiff's request that the deposition be conducted through written questions as set forth in Fed. R. Civ. P. 31, that Rule facially does not apply here because it only allows a deposing party to seek leave to proceed via written questions; it does not correspondingly entitle the party being deposed to demand a written deposition, and the plaintiff has not cited to any legal authority to suggest otherwise. To the extent the plaintiff invokes Rule 31 more generally, to suggest it as an alternative way to conduct the plaintiff's deposition given her present location, she has not provided sufficient facts to show her request is reasonable. Bearing in mind that it is the plaintiff who commenced this action and bears the burden of prosecution, she does not state how long she plans to remain abroad or indicate when she next plans to return to or visit the United States and thus would be available to sit for a deposition. She also does not indicate whether there are other times of the year when airfares may be substantially lest costly. On the contrary, the plaintiff's motion as framed seeks as a practical matter to circumvent Fed. R. Civ. P. 30(a)(1) and to prevent the plaintiff's oral deposition from taking place at all. As noted above, the plaintiff has not provided the court with any authority holding the court can grant such relief, or a basis to conclude it would be a reasonable way to proceed in this case.
