Magistrate Judge Donald L. Cabell: ELECTRONIC ORDER entered granting in part and denying in part 368 Motion to Compel. First, regarding the defendants' request to compel the plaintiffs to fully respond to their requests for production of documents, the defendants clarified in open court that this section of their motion was meant more as prelude and backdrop to the sections that followed, and did not relate to specific requests per se. Accordingly, no further discussion is necessary regarding this section. Second, regarding the defendants' request to compel the plaintiffs to produce records relating to the post-accident financial condition of the Katz Family Assets, the motion to compel is granted. To be sure, the plaintiffs have argued with vigor that the plaintiffs' post-accident financial condition is not relevant to calculating damages in a wrongful death case. Distilled to its essence, the plaintiffs appear to argue that no matter which state law governs, a cause of action for wrongful death accrues at the time of death, such that post-accident events play no role in the damages calculus. While that may be so, this is not a typical wrongful death action, and the plaintiffs have notwithstanding their argument specifically articulated a theory of damages that considers the performance of the family's portfolio without Lewis Katz's involvement, that is, a theory that in part examines how the family assets have performed post-accident under the plaintiffs' direction and care. Moreover, the plaintiffs seek damages for lost net inheritance on the theory that their future assets would have been higher had Lewis Katz not died prematurely. Against this backdrop, it is difficult to see how the plaintiffs can argue that post-accident financial related discovery is a priori irrelevant. Third, regarding the defendants' request to compel the plaintiffs to produce records relating to their 'valuation of consummated transactions theory," the motion to compel is granted based on the plaintiffs' representation in open court that they will produce the requested documents. Fourth, regarding the defendants' request for additional electronically stored information from the personal computers, personal mobile phones, personal email accounts, work-issued cell phones, and personal social media accounts of the plaintiffs, the motion to compel is granted in part and denied in part. The plaintiffs must collect and produce responsive ESI from their personal computers, personal mobile phones, personal email accounts and work-issued cell phones. With respect to requests yet to be served, the defendants should make best efforts to articulate what categories of documents they seek so that the plaintiffs may better determine what information may be responsive. The motion to compel is denied as it relates to the plaintiffs' social media accounts. Finally, regarding the defendants' requests for discovery pertaining to the domiciles of Lewis Katz, Marjorie Katz, Drew Katz, and Melisa Katz Silver, the motion to compel is granted in part and denied in part. The plaintiffs shall produce responsive documents relating to the domiciles of Lewis Katz, Drew Katz, and Melissa Katz Silver for the five year period preceding the accident, that is, between May 31, 2009 and May 31, 2014. As it relates to Marjorie Katz, any discovery of her domicile would be irrelevant in determining whether one particular state has more of an interest in adjudicating the claims at issue. This especially holds true where Marjorie Katz was estranged from Lewis Katz for some time prior to the accident and is not in any way a participant or subject of this lawsuit. For the reasons stated below, the Court DENIES the motion.At the time of his death, James McDowell was domiciled in Delaware. D. 251 ¶ 2. On June 7, 2016, Carol McDowell filed a Domiciliary Foreign Personal Representative's Sworn Statement ("FPRSS") in Suffolk Probate Court to enable her, in her capacity as personal representative for the McDowell estate, to bring a claim in Massachusetts state court arising from James McDowell's death. D. 251 ¶ 4. That suit settled on January 10, 2017. D. 274 ¶ 4.There is currently a dispute in Delaware state court between the McDowell estate and Global Aerospace, Inc. ("Global"), the insurer for not only the McDowell estate but also for multiple other defendants, regarding whether the insurance agreement between Global and James McDowell covered any liability arising from the underlying accident and, specifically, whether James McDowell was acted within the scope of his employment during the accident. D. 274 ¶ 13-14.The McDowell estate contends that under Delaware law, any claim not presented to an estate within eight months of the decedent's passing is forever barred against the estate, except to the extent the estate is insured, Del. Code. Ann. tit. 12 § 2102(a), and thus the McDowell estate is entitled to partial summary judgment prohibiting any recovery beyond its insurance coverage. D. 250-1 at 2. The Plaintiffs contend that this motion for partial summary judgment is not ripe for resolution. D. 269 at 10; D. 279-1 at 10.The parties are in agreement that the Court has subject matter jurisdiction over this case. It is appropriate, nevertheless, for the Court to determine whether, prudentially, the McDowell estate's motion for summary judgment is appropriate for consideration at this time based on the current state of litigation. See In re Rivera, No. 09-05079, 2013 WL 6834635, at *8 (Bankr. D.P.R. Dec. 23, 2013); Scharba v. Braden, No. 8:07-CV-1294-T-33TBM, 2008 WL 11336591, at *2 (M.D. Fla. Aug. 25, 2008); Rafferty v. Howard, No. 09-cv-260 LG-RHW, 2010 WL 3768142, at *1 (S.D. Miss. Sept. 20, 2010). In doing so, the Court may consider criteria such as the "fitness of the issues for judicial decision and the hardship to the parties of withholding court consideration." Mangual v. Rotger-Sabat, 317 F.3d 45, 59 (1st Cir. 2003) (quoting Abbott Labs v. Gardner, 387 U.S. 136, 149 (1967)).As the Plaintiffs point out, D. 269 at 11; D. 279-1 at 11, the Court will not need to adjudicate this issue if the McDowell estate is found not liable or if the damages attributed to the McDowell estate are less than its insurance coverage. There is no indication that resolving this issue now will help narrow the issues before trial, alter the scope of ongoing discovery or resolve any issues that would facilitate resolving this matter short of trial. To the extent that resolving this issue would shed light on the parties' respective positions with respect to the scope of insurance coverage, the scope of insurance coverage is not the subject of the litigation before this Court, but rather of a separate action in Delaware. Denying the McDowell estate's motion for summary judgment without prejudice preserves the right of this defendant to raise this issue if and when there is a finding of liability against the McDowell estate or consideration of this motion is otherwise warranted.For the foregoing reasons, the Court DENIES the McDowell estate's motion for partial summary judgment, D. 250, without prejudice. For the moment (and not to delay the kickoff of discovery), the parties should assume that the presumptive limits under Local Rule 26.1(c) apply. The Court will consider an expansion of the discovery event limitations for Defendants if they provide more information about why such expansion is needed, both collectively and individually, after conferring with counsel for Plaintiffs and attempting to reach agreement about such proposed expansion.
