Stearns: ELECTRONIC ORDER entered granting in part and denying in part 183 Motion to Compel The court previously requested that it be informed of "any outstanding discovery disputes not resolved by the parties by July 9, 2015." Order at Dkt. # 179. It then gave a one week extension of this deadline (to July 17, 2015) in order to permit the parties additional time to resolve their disagreements. Notwithstanding, the parties have an unresolved dispute regarding ESI search terms. The parties have until July 30, 2015 to either agree to ESI search terms or the plaintiffs must file a motion to compel informing the court of the precise nature of any remaining conflicts. This invitation is limited to ESI disputes. Defendant will have until August 4, 2015 to respond. The parties will have until August 21, 2015 to produce any remaining documents or ESI, including those produced by the final search terms. All fact discovery, including depositions, must be complete by October 23, 2015. Plaintiffs will have until September 11, 2015 to serve its expert reports. Defendants will have until October 4, 2015 to serve rebuttal report(s). The deadline for depositions of disclosed experts is October 23, 2015. Plaintiffs must file a motion for class certification on November 13, 2015. Defendant shall file its opposition by December 4, 2015. Replies will be by leave of the court. As to the remaining discovery disputes: Both parties must comply with ESI protocols. The individual plaintiffs identified on Opp'n page 8 have until August 10, 2015 to either produce the requested documents or make a declaration that they have no responsive documents in their possession. Defendant's interrogatory no. 11 (trial plan) is not a proper subject for an interrogatory and plaintiffs need not respond. Defendant has until August 21, 2015 to produce discovery responses for the plaintiffs that they have selected for both depositions and written discovery. Defendant has until August 10, 2015 to produce any document (whether created before or after the start of litigation) relating to classification decisions and that is not an attorney work product (defendants have not identified a local rule or local case law indicating that there is a privilege not to produce a privilege log). To the extent that plaintiffs' request to produce documents submitted in connection with unidentified "related lawsuits" concerns lawsuits filed by the same opt-in plaintiffs as are present in this case, the plaintiffs and defendant have equal access to the documents and the request is denied. Defendants have until August 10, 2015 to produce the time studies called for in plaintiffs' request number 30 both as to managers and hourly associates. Plaintiff has not identified any specific deficiencies in defendant's response to interrogatories 8 and 10, so this request is denied. The court's scheduling order (Dkt #146) is supplemented as follows: During Second-Phase Discovery the parties will take discovery on issues related to merits and certification, as well as damages. At the close of Second-Phase Discovery, plaintiffs shall file a Motion for Class Certification on August 28, 2015. Defendant shall file its opposition on September 18, 2015. Motions for Summary Judgment shall be filed when the Motion for Certification is due (August 28, 2015) and oppositions shall be filed when the opposition to certification is due (September 18, 2015). All replies will be by leave of the court. Per the parties' agreement, not later than 75 days before the close of Second-Phase Discovery (May 13, 2015), the parties shall supplement their Rule 26(a)(1) disclosures regarding identification of witnesses by identifying all witnesses from whom they intend to offer testimony in support of, or in opposition to, any Second-Phase Motion. The parties may depose the opposing party's disclosed witnesses, and these depositions will not count towards the deposition limits in the court's scheduling order at Dkt #146. The parties may not submit testimony in support of, or in opposition to, any Second-Phase Motion from any witness unless he/she was disclosed pursuant to the above or the party submitting the testimony could not have reasonably anticipated the need for the witness's testimony until being served with the opposing party's motion or opposition papers. If a party submits testimony from a witness not previously disclosed in accordance with this paragraph, the opposing party shall have the opportunity to depose such person prior to submitting opposition or reply papers (and, if necessary, the parties shall agree to reasonable extensions of the briefing schedule to allow for any such depositions). Regardless, and in all events, the Rule 26(a)(1) disclosures shall be supplemented in accordance with Rule 26(e)(1), even after the deadline to disclose Second-Phase Motion witnesses. Finally, per the parties' agreement, the thirty-one individuals who opted into the case subsequent to the December 5, 2014 deadline set by the court shall be permitted to join the opt-in class with an opt-in date of the dates their respective consent forms were filed with the court.
