To date CSX has had no response to its request for admissions and interrogatories, and Arrow has produced documents without pairing them to numbered requests or as kept in the ordinary course of business, and failed to provide a privilege log of withheld documents. Because time is of the essence with the impending October 20, 2016 Rule 30(b)(6) deposition of Arrow, and Nov. 4, 2016 mediation, Arrow must file responses, observant of the federal procedural rules, to CSX's request for admissions and interrogatories no later than October 17, 2016. Also by October 14, 2016, Arrow will pair the documents it has produced with each item or category of items sought in CSX's requests, and a log listing any responsive document withheld on the basis of privilege, citing that privilege as required under the Rules. Lastly, Arrow will provide CSX with a computation of alleged damages no later than October 11, 2016. Failure to comply with this Order will incur an award of expenses, and could result in a waiver of certain defenses and counterclaims, or a prohibition of use of evidence at dispositive motion or trial, or default.
