FINAL JUDGMENT - IT IS HEREBY ORDERED AND ADJUDGED that a jury has determined by its verdicts that as to Infringement, Bayer has not shown by a preponderance of the evidence that on or after August 13, 1996, Monsanto's MON 810 Bt corn has infringed any of the asserted claims of the '565 patent; that as to Prior Invention, Monsanto has shown by clear and convincing evidence that the asserted claims of the '565 patent are invalid because Dr. Fischhoff and Dr. Perlak at Monsanto invented the claimed subject matter before Bayer; that as to Obviousness, Monsanto has shown by clear and convincing evidence that the asserted claims of the '565 parent are invalid because theclaimed invention is obvious in view of the prior art; that no damages are awarded in favor of Bayer against Monsanto; and that Bayer has not shown by clear and convincing evidence that Monsanto's MON 810 willfully infringed. IT IS FURTHER ORDERED AND ADJUDGED that as to equitable issues before the Court, U.S. Patents 5,254,799; 5,767,372; 6,107,546; and 5,545,565 are unenforceable due to Bayer's inequitable conduct during patent prosecution. ORDER: IT IS HEREBY ORDERED that the opening statements shall be limited to 15 minutes for each side. Closing arguments will be limited to one-hour.IT IS FURTHER ORDERED that if deposition testimony is offered that was offered in the jury trial, the parties shall replay such testimony in full at the hearing. The parties shall play deposition testimony in video format during the hearing, rather than submitting the respective deposition transcripts or videos for in camera review by the Court. IT IS FURTHER ORDERED that all documents bates numbered ACS900001 through ACS 900254 will be admissible subject only to relevance objections. All documents can be addressed, subject to relevancy objections, by witnesses with personal knowledge, any expert thatdiscussed that particular topic in his or her expert report, or by the attorneys in briefing and closing arguments. IT IS FURTHER ORDERED that the parties shall submit findings of fact and conclusions of law following the equitable conduct hearing. IT IS FURTHER ORDERED that no later than February 1, 2006, the parties shall file a joint proposed scheduling plan. The scheduling plan shall contain: (1) a briefing schedule for thefiling of post-hearing findings of fact and conclusions of law and (2) briefing schedules for the filing of any other post-jury trial motions.IT IS FURTHER ORDERED that the parties' case presentations shall be divided evenly between the two parties. Time spent arguing an objection will be charged to the party making the objection. Time used during cross-examination will be charged to the party cross-examining the witness. The parties have the responsibility of keeping track of the time used by each party. The Stephens memorandum is inadmissable hearsay. So long as Bayer can lay the proper foundation, the September 1, 1995 document will be admissible if not offered to prove the truth of the matter asserted. IT IS FURTHER ORDERED that Monsanto's Sixth Motion in Limine to Preclude Bayer from Relying on Monsanto's Patent Prosecution and Biotechnology Paper as a Defense toMonsanto's Prior Invention Allegations [doc. #605] is DENIED. Bayer will be permitted to introduce evidence regarding Monsanto's failure to provoke an interference and the contrary results not included in the August 1997 Monsanto publication regarding success in creating insect resistant plants.IT IS FURTHER ORDERED that Monsanto's Seventh Motion in Limine PrecludingEvidence or Argument that Monsanto Needed to Know the Bt2 Sequence for a Conception [doc.#607] is GRANTED. Bayer is not permitted to rely on the '526 patent or testimony related to the ACE project relating to technology developed after the filing of the '565 patent in support of enablement. Bayer will be permitted to rely on any technology described therein that was known at the time of the '565 patent filing if, and only if, all information and corresponding documents relating the alleged failure of the ACE project has already been produced to Monsanto. If Bayer plans to rely on any technology described therein that was known at the time of the '565 patent filing, an attorney for Bayer shall file with the Court, no later than Monday, October 31, 2005 at 3:00 p.m., a sworn affidavit representing that all information and corresponding documents relating the alleged failure of the ACE project were produced. IT IS FURTHER ORDERED that Monsanto's Tenth Motion in Limine to Preclude Bayer from Offering Any Evidence Regarding RNA Splicing as a Basis for Infringement [doc.#643] is GRANTED.IT IS FURTHER ORDERED that Monsanto's Eleventh Motion in Limine RegardingEvidence of Secondary Considerations Supporting Non-Obviousness [doc. #644] is GRANTED. The Court will hold a hearing on that issue at a later date.
