ORDER ON DISCOVERY MOTIONS IT IS HEREBY ORDERED that the US shall have until 9/14/07, to determine whether to assert any state secrets privilage as to any information that may be at issue in this case, and to formally assert any such privilege. IT IS FURTHER ORDERED that the US shall have until 8/6/07, to state whether it agrees with the procedure for resolving any claim of privilege proposed by the Stahl Pltffs., or to propose its own procedure for resolving same. Any interesed party shall have 10 days thereafter to respond. IT IS FURTHER ORDERED that the mtn. to quash filed by the Boeing Co., and the related mtn. to compel directed to Boeing filed by the Stahl pltffs., are denied without prejudice, subject to refiling following the resolution of any state secrets privilege asserted by the US. Boeing's compliance with the subpoena is stayed to the extent that the US has directed that Boeing not make such disclosure pursuant to the possible assertion of the date secrets privilege. IT IS FURTHER ORDERED that the mtn. of pltff.'s Jackie and Linda Whitehead to clarify and restate this court's 5/15/07 order is granted in part and denied in part, as follows: (a) Should the Whitehead pltffs. seek a declaration from the court that they are no longer covered by the stay entered by this court, and that any assertion of the secrets privilege does not apply to them, then on or before 8/3/07, the Whitehead pltffs. shall file an amended complaint that is in compliance with paragraph 3 of the cmo, after which time the court will set a new schedule with respect to the claims asserted by the Whitehead pltffs. (b) In the alternative, in the event the Whitehead pltffs. believe that they are unable to comply with paragraph (a) above due to their inability to obtain necessary information from Boeing or any other entity, then on or before 8/3/07, the Whitehead pltffs. shall file a notice with the court so stating and informing the court of any and all actions they have taken, including formal and informal discovery requests and communications, to comply with paragraph 3 of the cmo, or to attempt to resolve or bring to the court's attention any state secrets issue asserted by Boeing or any other entity. The Whitehead pltffs. shall provide the court with copies of all relevant materials.
