FINAL JUDGMENT 1. On Count One of the First Amended Complaint, the Court finds for Plaintiffs on their claim that Hertz violated NRS § 482.31575.2. On Count Two of the First Amended Complaint, the Court finds for Defendants, noting that the Court previously dismissed this cause of action. See Doc. # 111 at 7-8. 3. On Count Three of the First Amended Complaint, the Court finds for Plaintiffs but declines to award additional damages on this cause of action. 4. The Court awards restitution in the amount of $42,321,890 to the class, and $11,115,583 in prejudgment interest.5. The Court awards attorney fees in accordance with the Court's Order regarding attorney fees entered on October 9, 2014. Doc. # 454 .6. The Court will consider motions from the parties regarding any cy pres distributions once the extent of unclaimed awards becomes more definite.7. The Court DENIES Hertz's Motion for Leave to File Notice of Supplemental Authority (Doc. # 453 ) as moot in light of the Court's Order regarding attorney fees (Doc. # 454 ).8. The Court states for the record the various pleadings before the Court. Mr. Stock addresses the Court regarding the status of the case to date. Mr. Peterson responds on behalf of the defendants and requests leave to file a motion to file a sur-reply to the reply that was filed by the plaintiff's regarding their Motion for Approval of Proposed Notice, Plan for Distribution of Notice 335 . Mr. Peterson indicates that the proposed sur-reply will be attached to the motion to be filed later today. The Court grants leave to file the motion. The Court addresses counsel and indicates he wants this case to move along. Any filings need to be filed promptly and as completely as possible. Mr. Greenberg addresses the Court regarding LR 54-16 in relation to filing attorney fees, further indicating that the rule doesn't conform to the posture of this case and requests leave to file request for attorney fees at the same time class counsel files their request, rather than after judgment. Mr. Greenberg indicates he will file a motion for the Court's clarification today or tomorrow, 6/12/13. Mr. Stock responds and clarifies for the Court the parties intentions regarding attorney fees. IT IS ORDERED that defendant's proposed motion shall be filed today, 6/11/13. IT IS FURTHER ORDERED that plaintiff's proposed motion shall be filed within 2 days, by 6/12/13. IT IS SO ORDERED.
